{"id":87573,"date":"2021-12-23T04:06:19","date_gmt":"2021-12-23T04:06:19","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=87573"},"modified":"2021-12-23T04:06:25","modified_gmt":"2021-12-23T04:06:25","slug":"comision-de-receso-de-la-scjn-admite-controversia-y-concede-suspension-en-contra-del-acuerdo-del-ine-por-el-que-se-determino-suspender-la-revocacion-de-mandato","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=87573","title":{"rendered":"COMISI\u00d3N DE RECESO DE LA SCJN ADMITE CONTROVERSIA Y CONCEDE SUSPENSI\u00d3N EN CONTRA DEL ACUERDO DEL INE POR EL QUE SE DETERMIN\u00d3 SUSPENDER LA REVOCACI\u00d3N DE MANDATO"},"content":{"rendered":"\n<p>Por Redacci\u00f3n QP<\/p>\n\n\n\n<p>La Comisi\u00f3n de Receso de la Suprema Corte de Justicia de la Naci\u00f3n, correspondiente al Segundo Periodo de Sesiones de 2021, acord\u00f3 admitir a tr\u00e1mite la controversia constitucional 224\/2021 promovida por la C\u00e1mara de Diputados del Congreso de la Uni\u00f3n en contra del Acuerdo aprobado por el Instituto Nacional Electoral (INE) en el que determin\u00f3 posponer la realizaci\u00f3n del proceso de Revocaci\u00f3n de Mandato 2021-2022.&nbsp;<\/p>\n\n\n\n<p>Con la admisi\u00f3n, se determin\u00f3 conceder la suspensi\u00f3n solicitada por la C\u00e1mara de Diputados del Congreso de la Uni\u00f3n, para que el INE se abstenga de ejecutar el acuerdo por el que pretend\u00eda posponer cualquiera de las actividades para la organizaci\u00f3n del proceso de revocaci\u00f3n de mandato del Presidente de la Rep\u00fablica y, en consecuencia, contin\u00fae con la organizaci\u00f3n y el desarrollo de la totalidad de las actividades del proceso de revocaci\u00f3n de mandato hasta su conclusi\u00f3n con el presupuesto aprobado de 1,503 millones de pesos el cual constituye un indicador de viabilidad financiera.<\/p>\n\n\n\n<p>Con la concesi\u00f3n de la suspensi\u00f3n se favorece la continuidad de un ejercicio democr\u00e1tico y ciudadano. Adem\u00e1s, el p\u00e1rrafo segundo del art\u00edculo 29 de la Constituci\u00f3n Pol\u00edtica del pa\u00eds establece que los derechos pol\u00edticos no pueden ser restringidos o suspendidos de manera general, por lo que la ejecuci\u00f3n del Acuerdo del INE pone en riesgo el ejercicio oportuno del derecho de la ciudadan\u00eda a decidir si revoca o no el mandato.<\/p>\n\n\n\n<p>Finalmente, cabe se\u00f1alar que la Comisi\u00f3n de Receso advirti\u00f3 lo determinado en el incidente de suspensi\u00f3n derivado de la diversa controversia constitucional 209\/2021, en la cual el Ministro Instructor sostuvo que resultaba improcedente conceder al INE la suspensi\u00f3n para el efecto de que no realizara ajustes a su presupuesto como se prev\u00e9 en el art\u00edculo Cuarto Transitorio del Decreto por el cual se expidi\u00f3 la Ley Federal de Revocaci\u00f3n de Mandato, de manera que ser\u00eda un contrasentido que lo que no obtuvo el INE en dicha controversia 209\/2021, este
