{"id":79768,"date":"2021-04-21T01:12:37","date_gmt":"2021-04-21T01:12:37","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=79768"},"modified":"2021-04-21T01:12:37","modified_gmt":"2021-04-21T01:12:37","slug":"invalida-scjn-el-requisito-de-no-haber-recibido-condena-por-delitos-dolosos-previsto-en-la-ley-de-adopciones-del-estado-de-chihuahua-al-resultar-discriminatorio","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=79768","title":{"rendered":"INVALIDA SCJN EL REQUISITO DE NO HABER RECIBIDO CONDENA POR DELITOS DOLOSOS PREVISTO EN LA LEY DE ADOPCIONES DEL ESTADO DE CHIHUAHUA AL RESULTAR DISCRIMINATORIO"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">INVALIDA SCJN EL REQUISITO DE NO HABER RECIBIDO CONDENA POR DELITOS DOLOSOS PREVISTO EN LA LEY DE ADOPCIONES DEL ESTADO DE CHIHUAHUA AL RESULTAR DISCRIMINATORIO<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 el art\u00edculo 9, fracci\u00f3n V, de la Ley de Adopciones del Estado de Chihuahua, en el que, como requisito para ejercer profesiones de trabajo social y psicolog\u00eda o carreras afines en las instituciones p\u00fablicas o privadas que realicen estudios socioecon\u00f3micos, psicol\u00f3gicos e informes psicosociales en materia de adopci\u00f3n, se establec\u00eda el \u201cno haber recibido condena por delitos dolosos\u201d.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Lo anterior, al considerar que dicha fracci\u00f3n resultaba contraria al derecho de igualdad y no discriminaci\u00f3n, pues su formulaci\u00f3n era en extremo general, al comprender a cualquier persona condenada por cualquier delito doloso, aun cuando no guardara relaci\u00f3n con la funci\u00f3n a encomendar. Adem\u00e1s, la norma tampoco acotaba la gravedad del delito o la pena impuesta, con lo que se inclu\u00eda incluso aquellos delitos a cuya comisi\u00f3n correspondiera una pena no privativa de libertad.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Adem\u00e1s, el Pleno consider\u00f3 que si bien las personas que ejercen dichas profesiones en el \u00e1mbito de la adopci\u00f3n de ni\u00f1as, ni\u00f1os y adolescentes, realizan una funci\u00f3n de orden p\u00fablico relacionada con la protecci\u00f3n reforzada de la que goza este grupo, lo cierto es que para asegurar el correcto desempe\u00f1o de su funci\u00f3n no es constitucionalmente v\u00e1lido recurrir a cuestiones estigmatizantes, tales como no haber recibido condena por delitos dolosos, ya que esto parte de prejuicios sociales.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 117\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez del art\u00edculo 9, fracci\u00f3n V, de la Ley de Adopciones del Estado de Chihuahua, publicada en el Peri\u00f3dico Oficial de esa entidad de 5 de febrero de 2020.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>INVALIDA SCJN EL REQUISITO DE NO HABER RECIBIDO CONDENA POR DELITOS DOLOSOS PREVISTO
