{"id":79687,"date":"2021-04-20T03:04:54","date_gmt":"2021-04-20T03:04:54","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=79687"},"modified":"2021-04-20T03:04:54","modified_gmt":"2021-04-20T03:04:54","slug":"scjn-invalida-dos-requisitos-para-ocupar-el-cargo-de-autoridad-auxiliar-en-los-municipios-del-estado-de-yucatan","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=79687","title":{"rendered":"SCJN INVALIDA DOS REQUISITOS PARA OCUPAR EL CARGO DE AUTORIDAD AUXILIAR EN LOS MUNICIPIOS DEL ESTADO DE YUCAT\u00c1N"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">SCJN INVALIDA DOS REQUISITOS PARA OCUPAR EL CARGO DE AUTORIDAD AUXILIAR EN LOS MUNICIPIOS DEL ESTADO DE YUCAT\u00c1N<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, declar\u00f3 la invalidez de dos requisitos para ser autoridad auxiliar de los ayuntamientos del Estado de Yucat\u00e1n, previstos en el art\u00edculo 70 bis, fracciones V y VI, de la Ley de Gobierno de los Municipios de dicha entidad.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Respecto del art\u00edculo 70 bis, fracci\u00f3n V, de dicho ordenamiento, que establec\u00eda el requisito consistente en no haber sido sentenciado por la comisi\u00f3n de delitos calificados como graves, el Pleno consider\u00f3 que dicha medida resultaba sobre-inclusiva y no guardaba relaci\u00f3n con el cargo a desempe\u00f1ar.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En relaci\u00f3n con el art\u00edculo 70 bis, fracci\u00f3n VI, de la misma normativa, que establec\u00eda el requisito consistente en no haber sido sancionado por actos de corrupci\u00f3n o inhabilitado para ocupar cargos p\u00fablicos, el Pleno estim\u00f3 que la norma resultaba sobre-inclusiva y no brindaba seguridad jur\u00eddica. Lo anterior, porque no se determinaba si correspond\u00eda al \u00e1mbito administrativo o penal; no se aclaraba si se refer\u00eda al tiempo por el cual la persona fue sancionada o sentenciada y si una vez trascurrido el tiempo de sanci\u00f3n era posible acceder al cargo; no se distingu\u00eda la gravedad de las sanciones; y, por \u00faltimo, no se advert\u00eda la relaci\u00f3n que el requisito guardaba con el cargo a desempe\u00f1ar.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 108\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez del art\u00edculo 70 Bis, fracciones V y VI de la Ley de Gobierno de los Municipios del Estado de Yucat\u00e1n, reformada mediante Decreto 165\/2020, publicado el 9 de enero de 2020, en el peri\u00f3dico oficial de la entidad.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>SCJN INVALIDA DOS REQUISITOS
