{"id":79329,"date":"2021-04-14T22:34:47","date_gmt":"2021-04-14T22:34:47","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=79329"},"modified":"2021-04-14T22:34:47","modified_gmt":"2021-04-14T22:34:47","slug":"relleno-sanitario-viola-derecho-un-medio-ambiente-sano-al-incumplir-la-norma-oficial-mexicana-por-lo-que-se-deberan-implementar-medidas-para-acatarla-de-lo-contrario-procede-la-clausura-segunda-s","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=79329","title":{"rendered":"RELLENO SANITARIO VIOLA DERECHO A UN MEDIO AMBIENTE SANO AL INCUMPLIR LA NORMA OFICIAL MEXICANA, POR LO QUE SE DEBER\u00c1N IMPLEMENTAR MEDIDAS PARA ACATARLA, DE LO CONTRARIO PROCEDE LA CLAUSURA: SEGUNDA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">RELLENO SANITARIO VIOLA DERECHO A UN MEDIO AMBIENTE SANO AL INCUMPLIR LA NORMA OFICIAL MEXICANA, POR LO QUE SE DEBER\u00c1N IMPLEMENTAR MEDIDAS PARA ACATARLA, DE LO CONTRARIO PROCEDE LA CLAUSURA: SEGUNDA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En sesi\u00f3n remota, la Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n resolvi\u00f3 que el relleno sanitario del municipio de Xonacatl\u00e1n, Estado de M\u00e9xico, incumple la Norma Oficial Mexicana NOM-083-SEMARNAT-2003 en materia de sitios de disposici\u00f3n final de residuos s\u00f3lidos urbanos y su manejo especial.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El relleno incumple con la normatividad al no localizarse en la distancia exigida respecto de las zonas habitadas, as\u00ed como a cuerpos de agua superficial aleda\u00f1os.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala estim\u00f3 que el caso implica la toma de una decisi\u00f3n prudencial para proteger el medio ambiente de los habitantes de la localidad en que se ubica el relleno sanitario, de tal suerte que concedi\u00f3 el amparo para que las autoridades responsables y la empresa concesionaria elaboren un plan de regularizaci\u00f3n que incluya la aplicaci\u00f3n de obras de ingenier\u00eda, tecnolog\u00edas y sistemas y, en general, diferentes acciones y medidas necesarias para cumplir lo previsto en la norma oficial citada.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Una vez presentado el plan de regularizaci\u00f3n, las autoridades competentes deber\u00e1n adoptar una decisi\u00f3n definitiva sobre las operaciones del relleno, tomando en consideraci\u00f3n a la comunidad. Si no se acredita que con la aplicaci\u00f3n de esas obras se cumple con lo previsto en la norma, las autoridades adoptar\u00e1n medidas para cerrar el relleno sanitario.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Amparo en revisi\u00f3n 237\/2020.
