{"id":79319,"date":"2021-04-14T21:31:46","date_gmt":"2021-04-14T21:31:46","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=79319"},"modified":"2021-04-14T21:31:46","modified_gmt":"2021-04-14T21:31:46","slug":"la-segunda-sala-resolvera-si-el-consejo-de-la-judicatura-federal-tiene-competencia-para-imponer-sanciones-un-particular-en-terminos-de-la-ley-general-de-responsabilidades-administrativas","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=79319","title":{"rendered":"LA SEGUNDA SALA RESOLVER\u00c1 SI EL CONSEJO DE LA JUDICATURA FEDERAL TIENE COMPETENCIA PARA IMPONER SANCIONES A UN PARTICULAR, EN T\u00c9RMINOS DE LA LEY GENERAL DE RESPONSABILIDADES ADMINISTRATIVAS"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LA SEGUNDA SALA RESOLVER\u00c1 SI EL CONSEJO DE LA JUDICATURA FEDERAL TIENE COMPETENCIA PARA IMPONER SANCIONES A UN PARTICULAR, EN T\u00c9RMINOS DE LA LEY GENERAL DE RESPONSABILIDADES ADMINISTRATIVAS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n resolvi\u00f3 un proyecto presentado por la Ministra Yasm\u00edn Esquivel Mossa y determin\u00f3 atraer un caso que requerir\u00e1 determinar si procede el juicio de amparo directo cuando es promovido por un particular en contra de una resoluci\u00f3n administrativa emitida por el Secretariado Ejecutivo de Disciplina del Consejo de la Judicatura Federal que le impone una responsabilidad administrativa por tr\u00e1fico de influencias.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En el caso, el amparo directo fue admitido por un tribunal colegiado, el cual fue recurrido por el Consejo de la Judicatura Federal, al considerar que el juicio de amparo es improcedente contra las determinaciones del propio Consejo.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al resolver la procedencia del juicio de amparo, la Segunda Sala podr\u00e1 establecer los alcances de la competencia del Consejo de la Judicatura Federal bajo el r\u00e9gimen de la Ley General de Responsabilidades Administrativas y el cauce que debe darse a los medios de impugnaci\u00f3n cuando los procedimientos no impliquen a servidores p\u00fablicos judiciales sino a particulares.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Solicitud de Ejercicio de la Facultad de Atracci\u00f3n 39\/2021.
