EN DERECHO O ABOGADO, PARA OCUPAR EL CARGO DE SECRETARIO DE AYUNTAMIENTO EN LOS MUNICIPIOS DE SAN LUIS POTOS\u00cd CON M\u00c1S DE CIEN MIL HABITANTES<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno efectuada a trav\u00e9s del sistema de videoconferencia, valid\u00f3 la porci\u00f3n normativa del art\u00edculo 77, fracci\u00f3n III, de la Ley Org\u00e1nica del Municipio Libre del Estado de San Luis Potos\u00ed, que dispone que para ocupar el cargo de Secretario de Ayuntamiento \u201cRespecto a las demarcaciones con poblaci\u00f3n de m\u00e1s de cien mil habitantes, ser\u00e1 necesario que el t\u00edtulo y c\u00e9dula profesional sean de licenciatura en derecho, o abogado\u201d.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El Tribunal Pleno determin\u00f3, en esencia, que la norma no transgrede el derecho humano a la igualdad porque establece un trato diferenciado que est\u00e1 justificado, al tratarse de una medida que busca garantizar la profesionalizaci\u00f3n en el desempe\u00f1o del cargo en poblaciones con mayor densidad poblacional, adem\u00e1s de que existen funciones que requieren conocimientos espec\u00edficos en materia jur\u00eddica, y las entidades federativas gozan de libertad configurativa para establecer los requisitos de acceso a cargos p\u00fablicos que no son de elecci\u00f3n popular.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 199\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez del art\u00edculo 77, fracci\u00f3n III, de la Ley Org\u00e1nica del Municipio Libre del Estado de San Luis Potos\u00ed, reformada mediante Decreto n\u00famero 0592, publicado en el Peri\u00f3dico Oficial de esa entidad de 27 de febrero de 2020.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LA SCJN RECONOCE LA VALIDEZ DEL
