{"id":77905,"date":"2021-03-25T17:54:49","date_gmt":"2021-03-25T17:54:49","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=77905"},"modified":"2021-03-25T17:54:49","modified_gmt":"2021-03-25T17:54:49","slug":"contra-la-resolucion-de-la-consejeria-juridica-del-ejecutivo-federal-que-declara-improcedente-el-indulto-una-persona-sentenciada-es-competente-el-juez-con-jurisdiccion-en-el-lugar-donde-se-ubica-el","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=77905","title":{"rendered":"CONTRA LA RESOLUCI\u00d3N DE LA CONSEJER\u00cdA JUR\u00cdDICA DEL EJECUTIVO FEDERAL QUE DECLARA IMPROCEDENTE EL INDULTO A UNA PERSONA SENTENCIADA, ES COMPETENTE EL JUEZ CON JURISDICCI\u00d3N EN EL LUGAR DONDE SE UBICA EL CENTRO PENITENCIARIO EN EL QUE \u00c9STA SE ENCUENTRE RECLUIDA: PRIMERA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">CONTRA LA RESOLUCI\u00d3N DE LA CONSEJER\u00cdA JUR\u00cdDICA DEL EJECUTIVO FEDERAL QUE DECLARA IMPROCEDENTE EL INDULTO A UNA PERSONA SENTENCIADA, ES COMPETENTE EL JUEZ CON JURISDICCI\u00d3N EN EL LUGAR DONDE SE UBICA EL CENTRO PENITENCIARIO EN EL QUE \u00c9STA SE ENCUENTRE RECLUIDA: PRIMERA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota de la Primera Sala, emiti\u00f3 jurisprudencia en la que estableci\u00f3 que cuando el acto reclamado sea una resoluci\u00f3n que determina la improcedencia de un indulto, ser\u00e1 legalmente competente para conocer del amparo indirecto el Juzgado de Distrito con jurisdicci\u00f3n en el lugar en donde se ubica el centro penitenciario en que se encuentra recluida la persona sentenciada.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En el fallo, la Primera Sala determin\u00f3 que si una persona present\u00f3 una solicitud de indulto cuya concesi\u00f3n implicar\u00eda, entre otras cuestiones, su liberaci\u00f3n ante la extinci\u00f3n de la pena, la resoluci\u00f3n que la determina improcedente tiene por consecuencia que el gobernado permanezca en su situaci\u00f3n actual y, por ello, \u00e9sta tiene una ejecuci\u00f3n material.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, precis\u00f3 que, conforme al art\u00edculo 37 de la Ley de Amparo, es competente el juez que tenga jurisdicci\u00f3n en el lugar en el que el acto reclamado deba tener ejecuci\u00f3n, trate de ejecutarse, se est\u00e9 ejecutando o se haya ejecutado.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por lo anterior, la Primera Sala concluy\u00f3 que si la ejecuci\u00f3n material del acto reclamado ocurrir\u00e1 en el lugar donde el sentenciado se encuentra recluido, porque all\u00ed se seguir\u00e1 ejecutando la pena cuya extinci\u00f3n solicit\u00f3, ser\u00e1 precisamente la persona juzgadora con jurisdicci\u00f3n en esa localidad, la que deber\u00e1 conocer del juicio de amparo que, en su caso, aqu\u00e9l interponga en contra de la resoluci\u00f3n que niega la solicitud de indulto al declararla improcedente.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Contradicci\u00f3n de tesis 95\/2020.
