{"id":77903,"date":"2021-03-25T17:48:05","date_gmt":"2021-03-25T17:48:05","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=77903"},"modified":"2021-03-25T17:48:05","modified_gmt":"2021-03-25T17:48:05","slug":"la-primera-sala-resolvera-un-caso-que-permitira-establecer-los-alcances-del-derecho-al-consentimiento-libre-e-informado-en-relacion-con-la-responsabilidad-civil-de-un-profesional-de-la-salud","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=77903","title":{"rendered":"LA PRIMERA SALA RESOLVER\u00c1 UN CASO QUE PERMITIR\u00c1 ESTABLECER LOS ALCANCES DEL DERECHO AL CONSENTIMIENTO LIBRE E INFORMADO EN RELACI\u00d3N CON LA RESPONSABILIDAD CIVIL DE UN PROFESIONAL DE LA SALUD"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LA PRIMERA SALA RESOLVER\u00c1 UN CASO QUE PERMITIR\u00c1 ESTABLECER LOS ALCANCES DEL DERECHO AL CONSENTIMIENTO LIBRE E INFORMADO EN RELACI\u00d3N CON LA RESPONSABILIDAD CIVIL DE UN PROFESIONAL DE LA SALUD<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota de la Primera Sala, determin\u00f3 atraer un asunto que permitir\u00e1 establecer los alcances del derecho del paciente de otorgar o no su consentimiento informado en la realizaci\u00f3n de tratamientos o procedimientos m\u00e9dicos, as\u00ed como de la obligaci\u00f3n de los profesionales de la salud de informarles sobre las caracter\u00edsticas del procedimiento y los riesgos que implica tal intervenci\u00f3n. Lo anterior, en relaci\u00f3n con los derechos humanos a la vida, la integridad f\u00edsica y a la libertad de conciencia.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El asunto emana de un juicio en materia civil, en el que una persona reclam\u00f3 de un profesional de la salud, la reparaci\u00f3n del da\u00f1o por negligencia m\u00e9dica, derivado de un procedimiento quir\u00fargico de car\u00e1cter est\u00e9tico. El juez de primera instancia conden\u00f3 al demandado al pago de responsabilidad civil, as\u00ed como a responder por los da\u00f1os y perjuicios y da\u00f1o moral causados. Inconformes, ambas partes interpusieron recurso de apelaci\u00f3n cuya sentencia absolvi\u00f3 al demandado, contra lo cual la persona demandante promovi\u00f3 un juicio de amparo directo.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Primera Sala atrajo el asunto de manera oficiosa, al considerar que es de inter\u00e9s y trascendencia porque permitir\u00e1, entre otros aspectos:<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Determinar si un profesional de la salud incurre en dolo cuando manifiesta que se puede obtener un resultado satisfactorio de una cirug\u00eda est\u00e9tica, en virtud de los conocimientos que ostenta tener;<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Definir si, en caso de que el profesional sea un m\u00e9dico, el dolo que llegue a realizar para promocionar sus servicios profesionales, puede impactar en el derecho de una persona a su consentimiento informado para someterse a un acto m\u00e9dico, a pesar de que \u00e9ste ya conoce los riesgos que podr\u00eda correr y su estado de salud particular, y<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Si el dolo en relaci\u00f3n con los servicios profesionales puede constituir un hecho il\u00edcito que genere una responsabilidad extracontractual por la que se pueda imputar negligencia m\u00e9dica, siempre y cuando se acredite un da\u00f1o y un nexo causal entre el deber de diligencia y los da\u00f1os reclamados.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, la Primera Sala precis\u00f3 que, si bien el derecho al consentimiento libre e informado implica que el paciente pueda asumir todos los riesgos y consecuencias inherentes o asociados a la intervenci\u00f3n autorizada, ello no excluye la responsabilidad m\u00e9dica cuando exista una actuaci\u00f3n negligente de los m\u00e9dicos o instituciones de salud involucrados, por lo que es necesario profundizar en los alcances de este derecho, cuando se enfrenta al libre ejercicio profesional.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Solicitud de ejercicio de la facultad de atracci\u00f3n 189\/2020.
