{"id":77483,"date":"2021-03-18T17:39:14","date_gmt":"2021-03-18T17:39:14","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=77483"},"modified":"2021-03-18T17:39:14","modified_gmt":"2021-03-18T17:39:14","slug":"en-el-contexto-de-la-pandemia-por-covid-19-es-posible-conceder-la-suspension-de-la-convivencia-presencial-entre-padres-e-hijos-para-que-se-realice-distancia-por-medios-electronicos-primera-sala","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=77483","title":{"rendered":"EN EL CONTEXTO DE LA PANDEMIA POR COVID-19 ES POSIBLE CONCEDER LA SUSPENSI\u00d3N DE LA CONVIVENCIA PRESENCIAL ENTRE PADRES E HIJOS PARA QUE SE REALICE A DISTANCIA, POR MEDIOS ELECTR\u00d3NICOS: PRIMERA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">EN EL CONTEXTO DE LA PANDEMIA POR COVID-19 ES POSIBLE CONCEDER LA SUSPENSI\u00d3N DE LA CONVIVENCIA PRESENCIAL ENTRE PADRES E HIJOS PARA QUE SE REALICE A DISTANCIA, POR MEDIOS ELECTR\u00d3NICOS: PRIMERA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota de la Primera Sala, emiti\u00f3 jurisprudencia conforme a la cual, en el contexto de la pandemia por COVID-19, puede concederse la suspensi\u00f3n del acto reclamado contra la determinaci\u00f3n judicial que ordena un r\u00e9gimen de convivencia presencial y libre entre un menor de edad y el progenitor que no tiene su custodia, para que \u00e9sta se desarrolle a distancia, a trav\u00e9s de medios electr\u00f3nicos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Lo anterior, como medida general de protecci\u00f3n reforzada que antepone la protecci\u00f3n de la vida y la salud f\u00edsica del menor, atendiendo a las condiciones de emergencia sanitaria por COVID-19, siempre y cuando al momento de resolver sobre la petici\u00f3n de la suspensi\u00f3n no se cuente con pruebas suficientes para determinar, a partir de un an\u00e1lisis del caso concreto, que el inter\u00e9s superior del menor involucrado, en su espec\u00edfica circunstancia, debe protegerse de una forma distinta.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Primera Sala enfatiz\u00f3 que tanto el derecho a la protecci\u00f3n de la salud y la vida, como el derecho a la convivencia con la madre o padre no custodio a efecto de mantener y estrechar el lazo familiar entre ellos, son derechos fundamentales para el bienestar de los menores de edad, que deben ser protegidos y garantizados.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Sin embargo, el contexto excepcional de la pandemia exige reconocer con mayor importancia el derecho a la protecci\u00f3n de la salud f\u00edsica y a la vida, frente al derecho a la convivencia presencial con el progenitor que no tiene la custodia del menor, a fin de que el primero pueda privilegiarse con mayor intensidad que el segundo, cuando no se cuente con elementos suficientes para decidir una medida que permita proteger ambos derechos de forma distinta.\u00a0<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">As\u00ed, la Primera Sala consider\u00f3 que al otorgarse la suspensi\u00f3n con efectos de modular la convivencia presencial para que se realice por medios electr\u00f3nicos se cumplen las exigencias que la ley prev\u00e9 para la medida; se protege la salud f\u00edsica y con ello de la vida del menor, al evitar exponerlo a un riesgo de contagio al tener que salir de su ambiente habitual y se favorece el seguimiento de las medidas preventivas de distanciamiento f\u00edsico y resguardo en el domicilio, aconsejadas por las instituciones y organismos de salud. Asimismo, esta medida protege el derecho del menor a gozar del mayor nivel posible de salud y procura compatibilizarlo con su derecho a la convivencia, cuando no se est\u00e1 en condiciones de determinar una mejor forma de proteger ambos derechos.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Contradicci\u00f3n de tesis 267\/2020.
