Por Redacci\u00f3n QP<\/p>\n

La Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota de Primera Sala, resolvi\u00f3 mediante jurisprudencia que, cuando el titular de una cuenta bancaria reclame la nulidad de una transferencia electr\u00f3nica, las instituciones financieras son las que deben probar que los procedimientos de identificaci\u00f3n del usuario, utilizados durante la transacci\u00f3n, fueron emitidos correctamente y que el procedimiento que se emple\u00f3 para autorizarla es fiable.<\/span><\/p>\n

En el fallo, la Primera Sala determin\u00f3 que la fiabilidad de la banca electr\u00f3nica no se puede presumir a partir de la sola acreditaci\u00f3n de que una transferencia se realiz\u00f3 mediante el uso del mecanismo de autenticaci\u00f3n del usuario con sus claves personales para autorizar las operaciones bancarias.<\/span><\/p>\n

Al respecto, precis\u00f3 que la presunci\u00f3n de fiabilidad s\u00f3lo se obtiene una vez que la instituci\u00f3n bancaria demuestre haber seguido el procedimiento exigido por las Disposiciones de Car\u00e1cter General aplicables a las Instituciones de Cr\u00e9dito, emitidas por la Comisi\u00f3n Nacional Bancaria y de Valores, que permitieran identificar una irregularidad al momento de realizarse la transferencia de recursos, entre las que destacan: 1) que el mecanismo de autenticaci\u00f3n correspond\u00eda al de la cuant\u00eda y formato de la operaci\u00f3n, 2) la emisi\u00f3n del comprobante y notificaci\u00f3n oportuna al usuario de la operaci\u00f3n respectiva, y 3) el debido seguimiento de los plazos establecidos para el registro de una cuenta destino del recurso transferido.<\/span><\/p>\n

La Primera Sala estim\u00f3 que, ante la existencia de diversas maneras de obtener fraudulentamente datos sensibles de los clientes o vulnerar contenido electr\u00f3nico para realizar operaciones sin el consentimiento de los usuarios, no puede prosperar la presunci\u00f3n de que las transferencias mediante mecanismos electr\u00f3nicos son infalibles.<\/span><\/p>\n

De manera que no es posible exigir al usuario del servicio que acredite la vulnerabilidad del sistema de transferencias, debido a la complejidad t\u00e9cnica y material que ello representa, as\u00ed como la protecci\u00f3n reforzada que le asiste como consumidor de un servicio financiero, pues es el banco quien cuenta con la infraestructura necesaria para generar la evidencia y presentarla ante los \u00f3rganos jurisdiccionales.<\/span><\/p>\n

En ese sentido, la Primera Sala concluy\u00f3 que, una vez que la instituci\u00f3n financiera acredite haber seguido el procedimiento normativo exigido para la operaci\u00f3n impugnada y que no tuvo conocimiento de incidentes que comprometieran los datos del cuentahabiente, s\u00f3lo entonces ser\u00e1 al usuario a quien corresponder\u00e1 desvirtuar lo afirmado por el banco.<\/span><\/p>\n
