{"id":77221,"date":"2021-03-12T04:35:18","date_gmt":"2021-03-12T04:35:18","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=77221"},"modified":"2021-03-12T04:35:18","modified_gmt":"2021-03-12T04:35:18","slug":"corresponde-los-tribunales-colegiados-resolver-los-conflictos-por-separacion-de-juicios-de-amparo-indirecto-bajo-las-reglas-previstas-para-la-acumulacion","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=77221","title":{"rendered":"CORRESPONDE A LOS TRIBUNALES COLEGIADOS RESOLVER LOS CONFLICTOS POR SEPARACI\u00d3N DE JUICIOS DE AMPARO INDIRECTO BAJO LAS REGLAS PREVISTAS PARA LA ACUMULACI\u00d3N"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">CORRESPONDE A LOS TRIBUNALES COLEGIADOS RESOLVER LOS CONFLICTOS POR SEPARACI\u00d3N DE JUICIOS DE AMPARO INDIRECTO BAJO LAS REGLAS PREVISTAS PARA LA ACUMULACI\u00d3N<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, resolvi\u00f3 una contradicci\u00f3n de tesis originada entre distintos tribunales colegiados que sostuvieron criterios diferentes respecto a si los conflictos entre jueces de distrito con motivo de la separaci\u00f3n de juicios en amparo indirecto deb\u00edan resolverse por el tribunal colegiado competente, o bien, si eran cuestiones meramente administrativas que deb\u00edan ser resueltas conforme a los mecanismos establecidos por el Consejo de la Judicatura Federal.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, el Pleno determin\u00f3 que a pesar de que la separaci\u00f3n de juicios no est\u00e1 prevista expresamente en la Ley de Amparo, su aplicaci\u00f3n se ha aceptado v\u00eda jurisprudencial, siguiendo las reglas de la acumulaci\u00f3n. Por tanto, atendiendo a dichas reglas, el conflicto entre juzgadores que se genere con motivo de la separaci\u00f3n de juicios deber\u00e1 ser resuelto por los tribunales colegiados, por lo que, en caso de oposici\u00f3n del juzgador a quien se le env\u00edan los actos que se estiman desvinculados, deber\u00e1 remitirlos a su superior, comunic\u00e1ndolo al juez de origen para que haga lo propio.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Contradicci\u00f3n de tesis 68\/2020, suscitada entre el Tribunal Colegiado en Materia Penal, el Primer Tribunal Colegiado en Materias Civil y Administrativa y el Segundo Tribunal Colegiado en Materias Civil y Administrativa, todos del Noveno Circuito, al resolver, respectivamente, los conflictos
