{"id":77181,"date":"2021-03-12T02:24:37","date_gmt":"2021-03-12T02:24:37","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=77181"},"modified":"2021-03-12T02:24:37","modified_gmt":"2021-03-12T02:24:37","slug":"es-inconstitucional-condicionar-el-derecho-la-modificacion-del-nombre-de-una-persona-la-presentacion-de-documentos-indubitables-e-inobjetables-primera-sala","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=77181","title":{"rendered":"ES INCONSTITUCIONAL CONDICIONAR EL DERECHO A LA MODIFICACI\u00d3N DEL NOMBRE DE UNA PERSONA A LA PRESENTACI\u00d3N DE DOCUMENTOS INDUBITABLES E INOBJETABLES: PRIMERA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">ES INCONSTITUCIONAL CONDICIONAR EL DERECHO A LA MODIFICACI\u00d3N DEL NOMBRE DE UNA PERSONA A LA PRESENTACI\u00d3N DE DOCUMENTOS INDUBITABLES E INOBJETABLES: PRIMERA SALA<\/span><\/strong><\/p>\n<p><strong>Por Redacci\u00f3n QP<\/strong><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota de la Primera Sala, resolvi\u00f3 que es inconstitucional el art\u00edculo 70, fracci\u00f3n I, del C\u00f3digo Civil para el Estado de Puebla, en la porci\u00f3n normativa que condiciona el derecho de una persona a modificar su nombre, cuando de manera invariable y constante ha usado en su vida social y jur\u00eddica otro nombre distinto al de su registro, a que presente documentos indubitables e inobjetables, auxiliados en su caso, con cualquier otra prueba, por considerar que se trata de una restricci\u00f3n innecesaria y desproporcional.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El caso emana de un juicio en el que una persona afirm\u00f3 haber usado otro nombre y apellidos tanto en su vida p\u00fablica como privada, ya que, al no tener contacto con su padre biol\u00f3gico, decidi\u00f3 tomar el apellido del esposo de su madre. Este hecho lo motiv\u00f3 a solicitar la correcci\u00f3n de su nombre. La petici\u00f3n fue negada en primera instancia, en la apelaci\u00f3n y un amparo promovido ante un Tribunal Colegiado. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Primera Sala advirti\u00f3 que, si bien la medida persigue una finalidad v\u00e1lida como lo es que una persona no efect\u00fae la modificaci\u00f3n de su nombre de manera fraudulenta por simple voluntad, lo cierto es que no hay una justificaci\u00f3n razonable para que la procedencia de la petici\u00f3n se sujete exclusivamente a pruebas documentales. De hecho, la propia legislaci\u00f3n civil del Estado de Puebla permite ofrecer todo tipo de pruebas siempre que no sean contrarias a la moral y el derecho.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En este sentido, la Primera Sala se\u00f1al\u00f3 que, considerar lo contrario, conllevar\u00eda a que muchos casos quedaran excluidos injustificadamente solo por no contar con esos documentos a pesar de tener otras pruebas que puedan generar plena convicci\u00f3n sobre la realidad a la cual pretenden cambiar su nombre. Es decir, la medida es desproporcionada y gravosa, pues impide garantizar el derecho a la modificaci\u00f3n del nombre de una persona, al exigir presentar indefectiblemente pruebas documentables y, adem\u00e1s, indubitables e inobjetables.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por lo anterior, la Primera Sala decidi\u00f3 revocar la sentencia y devolver el asunto al Tribunal Colegiado, a fin de que emita una nueva resoluci\u00f3n en la que tome en cuenta esa determinaci\u00f3n y las dem\u00e1s pruebas ofrecidas por la persona en el juicio de origen, particularmente la prueba testimonial.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Amparo Directo en Revisi\u00f3n 7691\/2019.
