{"id":75674,"date":"2021-02-18T01:19:23","date_gmt":"2021-02-18T01:19:23","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=75674"},"modified":"2021-02-18T01:19:23","modified_gmt":"2021-02-18T01:19:23","slug":"el-calculo-del-tope-maximo-de-pensiones-jubilatorias-de-los-trabajadores-del-estado-sujetos-al-articulo-decimo-transitorio-de-la-ley-del-issste-debe-determinarse-con-base-la-uma-segunda-sala-3","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=75674","title":{"rendered":"EL C\u00c1LCULO DEL TOPE M\u00c1XIMO DE PENSIONES JUBILATORIAS DE LOS TRABAJADORES DEL ESTADO, SUJETOS AL ART\u00cdCULO D\u00c9CIMO TRANSITORIO DE LA LEY DEL ISSSTE, DEBE DETERMINARSE CON BASE A LA UMA: SEGUNDA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">EL C\u00c1LCULO DEL TOPE M\u00c1XIMO DE PENSIONES JUBILATORIAS DE LOS TRABAJADORES DEL ESTADO, SUJETOS AL ART\u00cdCULO D\u00c9CIMO TRANSITORIO DE LA LEY DEL ISSSTE, DEBE DETERMINARSE CON BASE A LA UMA: SEGUNDA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala de la Suprema Corte de la Naci\u00f3n determin\u00f3, en sesi\u00f3n remota, que el tope m\u00e1ximo de la pensi\u00f3n jubilatoria otorgada por el Instituto de Seguridad Social y Servicios Sociales de los Trabajadores del Estado (ISSSTE) debe cuantificarse con base en la Unidad de Medida y Actualizaci\u00f3n (UMA), derivada de la reforma constitucional en materia de desindexaci\u00f3n del salario.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La reforma constitucional elimin\u00f3 el salario m\u00ednimo como par\u00e1metro para calcular el monto de pago de diversas obligaciones, multas, cr\u00e9ditos, y aportaciones de seguridad social. La finalidad de esta modificaci\u00f3n fue permitir que el salario m\u00ednimo pudiera ser incrementado constantemente para recuperar el poder adquisitivo de los trabajadores; ello sin que al mismo tiempo se incrementaran otra serie de conceptos ajenos al salario. La decisi\u00f3n de la Segunda Sala permitir\u00e1 que contin\u00fae la recuperaci\u00f3n del salario, sin poner en riesgo los fondos de pensiones.\u00a0<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por todo lo anterior, la Sala concluy\u00f3 que, acorde con la Constituci\u00f3n Federal, la Ley del ISSSTE abrogada y el art\u00edculo D\u00e9cimo transitorio de la Ley del ISSSTE vigente, el tope m\u00e1ximo de la pensi\u00f3n jubilatoria debe calcularse con base en la
