{"id":75663,"date":"2021-02-18T00:24:25","date_gmt":"2021-02-18T00:24:25","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=75663"},"modified":"2021-02-18T00:24:25","modified_gmt":"2021-02-18T00:24:25","slug":"el-calculo-del-tope-maximo-de-pensiones-jubilatorias-de-los-trabajadores-del-estado-sujetos-al-articulo-decimo-transitorio-de-la-ley-del-issste-debe-determinarse-con-base-la-uma-segunda-sala-2","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=75663","title":{"rendered":"EL C\u00c1LCULO DEL TOPE M\u00c1XIMO DE PENSIONES JUBILATORIAS DE LOS TRABAJADORES DEL ESTADO, SUJETOS AL ART\u00cdCULO D\u00c9CIMO TRANSITORIO DE LA LEY DEL ISSSTE, DEBE DETERMINARSE CON BASE A LA UMA: SEGUNDA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">EL C\u00c1LCULO DEL TOPE M\u00c1XIMO DE PENSIONES JUBILATORIAS DE LOS TRABAJADORES DEL ESTADO, SUJETOS AL ART\u00cdCULO D\u00c9CIMO TRANSITORIO DE LA LEY DEL ISSSTE, DEBE DETERMINARSE CON BASE A LA UMA: SEGUNDA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n determin\u00f3, en sesi\u00f3n remota, que el tope m\u00e1ximo de la pensi\u00f3n jubilatoria otorgada por el Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado (ISSSTE) debe cuantificarse con base en la Unidad de Medida y Actualizaci\u00f3n (UMA), derivada de la reforma constitucional en materia de desindexaci\u00f3n del salario.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Conforme a la reforma, se elimin\u00f3 al salario m\u00ednimo como par\u00e1metro para calcular el monto en el pago de diversas obligaciones en materia de impuestos, multas y actividades econ\u00f3micas. La finalidad de esta modificaci\u00f3n fue aumentar los ingresos de los trabajadores con menores remuneraciones, as\u00ed como las cuotas y aportaciones de seguridad social. As\u00ed, al ser la pensi\u00f3n una obligaci\u00f3n del Estado, le resulta aplicable la Unidad de Medida y Actualizaci\u00f3n.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por lo cual, la Sala concluy\u00f3 que, conforme a la Ley del ISSSTE, abrogada, y al art\u00edculo D\u00e9cimo transitorio de la Ley del ISSSTE vigente, el tope m\u00e1ximo de la pensi\u00f3n jubilatoria debe calcularse con base en la UMA.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Contradicci\u00f3n de tesis 200\/2020.
