{"id":75488,"date":"2021-02-16T02:06:27","date_gmt":"2021-02-16T02:06:27","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=75488"},"modified":"2021-02-16T02:06:27","modified_gmt":"2021-02-16T02:06:27","slug":"analiza-scjn-reforma-la-constitucion-de-sonora-en-materia-de-leyes-de-ingresos-y-presupuestos-de-egresos-municipales","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=75488","title":{"rendered":"ANALIZA SCJN REFORMA A LA CONSTITUCI\u00d3N DE SONORA EN MATERIA DE LEYES DE INGRESOS Y PRESUPUESTOS DE EGRESOS MUNICIPALES"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">ANALIZA SCJN REFORMA A LA CONSTITUCI\u00d3N DE SONORA EN MATERIA DE LEYES DE INGRESOS Y PRESUPUESTOS DE EGRESOS MUNICIPALES<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, analiz\u00f3 las impugnaciones a la Ley N\u00famero 288 por la que se reforman, derogan y adicionan diversas disposiciones de la Constituci\u00f3n Pol\u00edtica del Estado de Sonora, publicada el 13 de agosto de 2018, y determin\u00f3 que no se actualizaron las violaciones al proceso legislativo que invoc\u00f3 en su demanda el municipio de Caborca. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, el Tribunal Pleno invalid\u00f3, con efectos limitados al territorio de ese municipio, la porci\u00f3n normativa \u201co no aprobar\u201d prevista en la fracci\u00f3n XXIV del art\u00edculo 64 de la ley impugnada, por vulnerar el principio de libertad hacendaria municipal previsto en el art\u00edculo 115 de la Constituci\u00f3n General. Dicha norma establec\u00eda la facultad del Congreso local de discutir, modificar, aprobar o no aprobar anualmente las Leyes de Ingresos y Presupuestos de Ingresos de los Ayuntamientos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La SCJN tambi\u00e9n reconoci\u00f3 la validez de las fracciones VII, p\u00e1rrafo segundo; IX y XII del art\u00edculo 79, de la Constituci\u00f3n del Estado, relativas a las facultades y obligaciones del titular del Poder Ejecutivo del Estado, en materia de proyectos de presupuesto de ingresos y egresos, al concluir que dichos preceptos no vulneran las atribuciones del municipio actor y no producen ninguna afectaci\u00f3n a su hacienda, o de manera espec\u00edfica, a las participaciones o aportaciones federales que reciben los municipios.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Controversia constitucional 175\/2018, promovida por el Municipio de Caborca, Sonora, en contra del Poder Legislativo del mencionado Estado, demandando la invalidez de la Ley N\u00famero 288 que reforma, deroga y adiciona diversas disposiciones de la Constituci\u00f3n Pol\u00edtica de esa entidad, publicada en el Bolet\u00edn Oficial local de 13 de agosto de 2018.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>ANALIZA SCJN
