{"id":75039,"date":"2021-02-10T23:41:11","date_gmt":"2021-02-10T23:41:11","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=75039"},"modified":"2021-02-10T23:41:11","modified_gmt":"2021-02-10T23:41:11","slug":"los-sujetos-obligados-deben-obtener-el-consentimiento-de-titulares-de-informacion-confidencial-cuando-es-solicitada-por-un-particular-ante-una-unidad-de-transparencia-segunda-sala","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=75039","title":{"rendered":"LOS SUJETOS OBLIGADOS DEBEN OBTENER EL CONSENTIMIENTO DE TITULARES DE INFORMACI\u00d3N CONFIDENCIAL CUANDO ES SOLICITADA POR UN PARTICULAR ANTE UNA UNIDAD DE TRANSPARENCIA: SEGUNDA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LOS SUJETOS OBLIGADOS DEBEN OBTENER EL CONSENTIMIENTO DE TITULARES DE INFORMACI\u00d3N CONFIDENCIAL CUANDO ES SOLICITADA POR UN PARTICULAR ANTE UNA UNIDAD DE TRANSPARENCIA: SEGUNDA SALA<\/span><\/strong><\/p>\n<p><b>Por Redacci\u00f3n QP<\/b><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n, en sesi\u00f3n remota, reafirm\u00f3 la constitucionalidad de diversas disposiciones de la Ley Federal y de la Ley General de Transparencia y Acceso a la Informaci\u00f3n P\u00fablica.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El caso se vincula a un ciudadano que solicit\u00f3 al Banco Nacional de Comercio Exterior informaci\u00f3n sobre los pr\u00e9stamos o cr\u00e9ditos otorgados a dos empresas. Al respecto, el Instituto Nacional de Transparencia y Acceso a la Informaci\u00f3n P\u00fablica resolvi\u00f3 que, conforme a las leyes federales de la materia, la instituci\u00f3n bancaria est\u00e1 obligada a proporcionar la informaci\u00f3n.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Inconforme, una de las empresas argumenta que, con esta resoluci\u00f3n, se vulneraron sus derechos de audiencia y de protecci\u00f3n de datos personales, porque no se les notific\u00f3 del procedimiento.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, la Sala reafirm\u00f3 el criterio sostenido por la Corte de que, cuando se trata de informaci\u00f3n de car\u00e1cter confidencial, los sujetos obligados deben obtener el consentimiento de los particulares para que puedan ejercer sus derechos ARCO (acceso, rectificaci\u00f3n, cancelaci\u00f3n y oposici\u00f3n), con lo que se garantiza el derecho de audiencia y se protege la informaci\u00f3n de cualquier intromisi\u00f3n arbitraria por parte de terceros.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por lo anterior, la Segunda Sala concluy\u00f3 que se debe reponer en su totalidad el procedimiento con la finalidad de que tanto el Banco como el Instituto, en su calidad de depositarios, notifiquen y obtengan el consentimiento de las empresas titulares de la informaci\u00f3n solicitada de modo que est\u00e9n en aptitud de manifestar lo que a su derecho convenga.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Amparo en revisi\u00f3n 426\/2020.
