LA PRIMERA SALA ACEPTA CONOCER DE UN ASUNTO RELACIONADO CON LA PROTECCI\u00d3N DEL MEDIO AMBIENTE EN LAS OBRAS DE AMPLIACI\u00d3N DEL PUERTO DE VERACRUZ<\/span><\/strong><\/p>\n

\u00a0Por Redacci\u00f3n QP<\/strong><\/p>\n

La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota de Primera Sala, acept\u00f3 conocer de la revisi\u00f3n de un amparo cuyo estudio permitir\u00e1 fijar criterios para casos futuros en los que se examine el inter\u00e9s leg\u00edtimo colectivo y el derecho humano de acceso a un medio ambiente sano, particularmente cuando se controvierten obras que, a primera vista, tambi\u00e9n pueden traer consigo beneficios para la sociedad o para la econom\u00eda nacional, como el caso de la ampliaci\u00f3n de un recinto portuario.<\/span><\/p>\n

El caso emana de una demanda de amparo indirecto promovida en lo individual por las quejosas, en el cual reclamaron que diversas acciones y omisiones destinadas a autorizar y realizar el proyecto de ampliaci\u00f3n del Puerto de Veracruz no garantizaron, bajo el est\u00e1ndar m\u00e1s alto de protecci\u00f3n, su derecho humano a un medio ambiente sano. Al respecto, el juez de distrito sobresey\u00f3 el amparo por considerar que las quejosas no contaban con inter\u00e9s leg\u00edtimo para promoverlo; resoluci\u00f3n contra la cual las afectadas presentaron recurso de revisi\u00f3n, mismo que solicitaron fuera atra\u00eddo por la Suprema Corte de Justicia de la Naci\u00f3n.<\/span><\/p>\n

Al resolver sobre la solicitud, la Primera Sala determin\u00f3 ejercer tal facultad, al considerar que el asunto reviste inter\u00e9s y trascendencia, toda vez que con su resoluci\u00f3n se podr\u00eda continuar en la construcci\u00f3n de su l\u00ednea jurisprudencial en torno a la figura del inter\u00e9s leg\u00edtimo de personas f\u00edsicas que acuden al juicio de amparo alegando la vulneraci\u00f3n del derecho humano a un medio ambiente sano.<\/span><\/p>\n

Asimismo, la Sala estim\u00f3 que la decisi\u00f3n que en su momento se emita permitir\u00e1, entre otros aspectos:<\/span><\/p>\n

    \n
  1. Delimitar el est\u00e1ndar probatorio aplicable para aquellas personas que afirman resentir una especial situaci\u00f3n frente al orden jur\u00eddico, cuando est\u00e1 de por medio la afectaci\u00f3n o el impacto sobre un bien colectivo o un ecosistema, como el Parque Nacional Sistema Arrecifal Veracruzano;<\/span><\/li>\n
  2. Reiterar su doctrina constitucional esbozada a partir del amparo en revisi\u00f3n 307\/2016, en el cual se exploraron los alcances del derecho humano a un medio ambiente sano y diversos principios relacionados con el mismo, tal y como el de precauci\u00f3n previsto en el art\u00edculo 15 de la Convenci\u00f3n de R\u00edo sobre el Medio Ambiente y el Desarrollo, y<\/span><\/li>\n
  3. Verificar si los actos y obras autorizadas para la ampliaci\u00f3n del Puerto de Veracruz efectivamente fueron emitidos en detrimento del derecho a un medio ambiente sano. <\/span><\/li>\n<\/ol>\n

    Finalmente, la Sala destac\u00f3 la relevancia de este asunto al no estar limitado a analizar intereses estrictamente particulares, sino colectivos, tanto por la naturaleza del derecho humano en juego, como por las obras materiales que los actos reclamados conllevan.<\/span><\/p>\n
