{"id":72209,"date":"2021-01-14T05:05:38","date_gmt":"2021-01-14T05:05:38","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=72209"},"modified":"2021-01-14T05:05:38","modified_gmt":"2021-01-14T05:05:38","slug":"la-segunda-sala-de-la-scjn-ratifica-el-derecho-de-consulta-previa-de-los-pueblos-indigenas-en-especifico-del-pueblo-maseual-en-sesion-celebrada-via-remota-el-dia-de-hoy-la-segunda-sala-de-la-su","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=72209","title":{"rendered":"LA SEGUNDA SALA DE LA SCJN RATIFICA EL DERECHO DE CONSULTA PREVIA DE LOS PUEBLOS IND\u00cdGENAS, EN ESPEC\u00cdFICO, DEL PUEBLO MASEUAL"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LA SEGUNDA SALA DE LA SCJN RATIFICA EL DERECHO DE CONSULTA PREVIA DE LOS PUEBLOS IND\u00cdGENAS, EN ESPEC\u00cdFICO, DEL PUEBLO MASEUAL<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En sesi\u00f3n celebrada v\u00eda remota el d\u00eda de hoy, la Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n <strong data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">ratific\u00f3<\/strong> que conforme a la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos y al Convenio 169 Sobre Pueblos Ind\u00edgenas y Tribales en Pa\u00edses Independientes de la Organizaci\u00f3n Internacional del Trabajo<strong data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">, todas las autoridades de nuestro pa\u00eds<\/strong>, en el \u00e1mbito de su respectiva competencia, <strong data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">est\u00e1n obligadas a consultar a los pueblos y comunidades ind\u00edgenas<\/strong> antes de adoptar alguna acci\u00f3n o medida susceptibles de afectar sus derechos e intereses.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, resolvi\u00f3 que la Ley Minera no es inconstitucional por no prever dicha consulta, ya que la obligaci\u00f3n de hacerlo est\u00e1 prevista en la Norma Suprema y en un Convenio Internacional y, por eso, aplica para todas las materias, incluida sin duda alguna la miner\u00eda, sin que sea necesario que cada ley lo tenga que prever o regular. Sujetar la obligatoriedad de la consulta a su reconocimiento en una ley secundaria ser\u00eda reducirla a un texto normativo de menor jerarqu\u00eda.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Es importante se\u00f1alar que previamente, al resolver otros asuntos, la Segunda Sala ya hab\u00eda resuelto que s\u00ed existe obligaci\u00f3n del Congreso de la Uni\u00f3n de emitir una ley que regule el derecho de consulta ind\u00edgena con el objetivo de otorgar seguridad jur\u00eddica a todos los gobernados y, sobre todo, a los grupos y comunidades ind\u00edgenas, en cuanto a las etapas, caracter\u00edsticas y dem\u00e1s aspectos generales que deben satisfacerse al realizarse dicho procedimiento, independientemente de la materia objeto de la consulta, es decir, si se trata de un tema minero, ecol\u00f3gico, de salud, entre otros.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Amparo en revisi\u00f3n 928\/2019, resuelto en sesi\u00f3n de 13 de enero de 2021, por unanimidad de
