{"id":72120,"date":"2021-01-13T04:29:28","date_gmt":"2021-01-13T04:29:28","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=72120"},"modified":"2021-01-13T04:29:28","modified_gmt":"2021-01-13T04:29:28","slug":"scjn-reconoce-la-validez-del-procedimiento-de-designacion-ante-ausencias-injustificadas-de-funcionarios-del-poder-ejecutivo-de-nuevo-leon-y-declara-la-invalidez-de-la-sancion-prevista-en-caso-de-no-cu","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=72120","title":{"rendered":"SCJN RECONOCE LA VALIDEZ DEL PROCEDIMIENTO DE DESIGNACI\u00d3N ANTE AUSENCIAS INJUSTIFICADAS DE FUNCIONARIOS DEL PODER EJECUTIVO DE NUEVO LE\u00d3N Y DECLARA LA INVALIDEZ DE LA SANCI\u00d3N PREVISTA EN CASO DE NO CUMPLIRSE CON DICHO PROCEDIMIENTO"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">SCJN RECONOCE LA VALIDEZ DEL PROCEDIMIENTO DE DESIGNACI\u00d3N ANTE AUSENCIAS INJUSTIFICADAS DE FUNCIONARIOS DEL PODER EJECUTIVO DE NUEVO LE\u00d3N Y DECLARA LA INVALIDEZ DE LA SANCI\u00d3N PREVISTA EN CASO DE NO CUMPLIRSE CON DICHO PROCEDIMIENTO<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, determin\u00f3 que en el proceso legislativo que dio origen al Decreto 140, por medio del cual se reform\u00f3 el art\u00edculo 85, fracci\u00f3n XXIV, p\u00e1rrafos segundo y tercero, de la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Nuevo Le\u00f3n, publicado el 24 de mayo de 2019, no se cometieron violaciones con car\u00e1cter invalidante.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El Pleno reconoci\u00f3 la validez del p\u00e1rrafo segundo de dicho precepto, que establece que en caso de ausencias mayores a quince d\u00edas h\u00e1biles sin causa justificada del Secretario de Finanzas y Tesorero General del Estado y del Titular del \u00d3rgano Interno de Control del Estado, el Gobernador debe realizar la propuesta de nombramiento sobre dichos cargos al Congreso Local dentro del t\u00e9rmino de noventa d\u00edas naturales. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Se consider\u00f3 que dicho p\u00e1rrafo no transgrede el principio de divisi\u00f3n de poderes, pues dada la importancia de las funciones que desempe\u00f1an los titulares de esos cargos, el Congreso Local regul\u00f3 lo relacionado con las ausencias temporales sin causa justificada, bajo el mismo esquema de colaboraci\u00f3n interinstitucional con el que son nombrados.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Sin embargo, la SCJN declar\u00f3 la invalidez del p\u00e1rrafo tercero de dicho precepto, en el que se establec\u00eda que, en caso de no cumplirse con lo previsto en el p\u00e1rrafo segundo, los actos emanados de quien realice las funciones ser\u00edan inexistentes. El Pleno determin\u00f3 que dicha sanci\u00f3n resultaba excesiva y violaba los principios de seguridad jur\u00eddica y divisi\u00f3n de poderes.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Controversia constitucional 266\/2019, promovida por el Poder Ejecutivo del Estado de Nuevo Le\u00f3n en contra del Poder Legislativo de dicho Estado, demandando la invalidez del Decreto 140, por medio del cual se reform\u00f3 el art\u00edculo 85, fracci\u00f3n XXIV, p\u00e1rrafos segundo y tercero, de la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Nuevo Le\u00f3n, publicado el 24 de mayo de 2019, en el Peri\u00f3dico Oficial
