{"id":71658,"date":"2021-01-08T00:09:44","date_gmt":"2021-01-08T00:09:44","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=71658"},"modified":"2021-01-08T00:09:44","modified_gmt":"2021-01-08T00:09:44","slug":"invalida-scjn-disposiciones-de-la-ley-del-sistema-de-seguridad-ciudadana-de-la-ciudad-de-mexico-que-versaban-sobre-informacion-reservada-y-aplicacion-de-leyes-supletorias","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=71658","title":{"rendered":"INVALIDA SCJN DISPOSICIONES DE LA LEY DEL SISTEMA DE SEGURIDAD CIUDADANA DE LA CIUDAD DE M\u00c9XICO QUE VERSABAN SOBRE INFORMACI\u00d3N RESERVADA Y APLICACI\u00d3N DE LEYES SUPLETORIAS"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">INVALIDA SCJN DISPOSICIONES DE LA LEY DEL SISTEMA DE SEGURIDAD CIUDADANA DE LA CIUDAD DE M\u00c9XICO QUE VERSABAN SOBRE INFORMACI\u00d3N RESERVADA Y APLICACI\u00d3N DE LEYES SUPLETORIAS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, al analizar las impugnaciones a la Ley del Sistema de Seguridad Ciudadana de la Ciudad de M\u00e9xico, declar\u00f3 inconstitucional la porci\u00f3n del art\u00edculo 131 donde, al referirse a la reserva de la informaci\u00f3n contenida en la Plataforma Integral de Seguridad Ciudadana, se establec\u00eda: \u201ccuya consulta es exclusiva de las instituciones de seguridad ciudadana que est\u00e9n facultadas en cada caso, a trav\u00e9s de las personas servidoras p\u00fablicas que cada instituci\u00f3n designe, por lo que el p\u00fablico no tendr\u00e1 acceso a la informaci\u00f3n que en ellos se contenga\u201d. Lo anterior, pues imped\u00eda a los particulares ejercer su derecho de acceso a la informaci\u00f3n de forma absoluta y anticipada, lo que, conforme a precedentes, resulta violatorio del principio de m\u00e1xima publicidad contenido en el art\u00edculo 6, apartado A, fracci\u00f3n I, de la Constituci\u00f3n. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, el Pleno invalid\u00f3 el art\u00edculo 3, fracci\u00f3n I, donde se indicaba que, a falta de previsi\u00f3n expresa en la ley analizada respecto del apoyo y coordinaci\u00f3n interinstitucional de los tres \u00f3rdenes de gobierno, se aplicar\u00edan de manera supletoria la Ley General del Sistema Nacional de Seguridad P\u00fablica, la Ley de la Guardia Nacional y la Ley Nacional sobre el Uso de la Fuerza.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Finalmente, el Pleno valid\u00f3: a) el art\u00edculo 8, relativo a los derechos que el Gobierno de la Ciudad de M\u00e9xico tiene obligaci\u00f3n de garantizar en materia de seguridad; b) el art\u00edculo 59, fracci\u00f3n XXI, que establece la obligaci\u00f3n de los integrantes de las instituciones de seguridad ciudadana de abstenerse de realizar conductas que desacrediten su persona o la imagen de dichas instituciones; y c) el art\u00edculo 42, fracci\u00f3n XI, el cual establece que el Consejo Ciudadano para la Seguridad Ciudadana y Procuraci\u00f3n de Justicia podr\u00e1 recibir, evaluar, canalizar y formular denuncias por violaciones a derechos humanos cometidas por instituciones o servidores en materia de cultura c\u00edvica, seguridad ciudadana y procuraci\u00f3n de justicia.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acciones de inconstitucionalidad 95\/2019 y su acumulada 98\/2019, promovidas por la Comisi\u00f3n Nacional de los Derechos Humanos y la Comisi\u00f3n de Derechos Humanos de la Ciudad de M\u00e9xico, demandando la invalidez de diversas disposiciones de la Ley del Sistema de Seguridad Ciudadana de la Ciudad de M\u00e9xico, publicada en la Gaceta Oficial local de 1\u00b0 de agosto de 2019.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>INVALIDA SCJN DISPOSICIONES DE LA LEY DEL SISTEMA DE SEGURIDAD CIUDADANA DE
