{"id":70939,"date":"2020-12-29T18:59:52","date_gmt":"2020-12-29T18:59:52","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70939"},"modified":"2020-12-29T18:59:52","modified_gmt":"2020-12-29T18:59:52","slug":"el-delito-de-posesion-de-arma-de-fuego-de-uso-exclusivo-del-ejercito-se-actualiza-cuando-una-persona-la-tiene-o-la-lleva-consigo-en-el-interior-de-su-domicilio","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70939","title":{"rendered":"EL DELITO DE POSESI\u00d3N DE ARMA DE FUEGO DE USO EXCLUSIVO DEL EJ\u00c9RCITO SE ACTUALIZA CUANDO UNA PERSONA LA TIENE O LA LLEVA CONSIGO EN EL INTERIOR DE SU DOMICILIO"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">EL DELITO DE POSESI\u00d3N DE ARMA DE FUEGO DE USO EXCLUSIVO DEL EJ\u00c9RCITO SE ACTUALIZA CUANDO UNA PERSONA LA TIENE O LA LLEVA CONSIGO EN EL INTERIOR DE SU DOMICILIO<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, a trav\u00e9s de su Primera Sala, estableci\u00f3 que el delito de posesi\u00f3n de arma de fuego de uso exclusivo del Ej\u00e9rcito, Armada y Fuerza A\u00e9rea se actualiza cuando una persona lleve el artefacto de estas caracter\u00edsticas aun dentro de su domicilio.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">De acuerdo\u00a0 con la Constituci\u00f3n y con la Ley Federal de Armas de Fuego y Explosivos, para determinar si se actualiza el delito de posesi\u00f3n, o bien, el de portaci\u00f3n de arma de fuego de uso exclusivo del Ej\u00e9rcito, Armada o Fuerza A\u00e9rea, es relevante el lugar en que se tenga el arma de fuego, de manera que la posesi\u00f3n se dar\u00e1 cuando una persona la tiene o la lleva consigo en el interior de su domicilio, mientras que la portaci\u00f3n ser\u00e1 cuando la tiene o la lleva consigo fuera del hogar.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Sala explic\u00f3 que no se configura el delito de portaci\u00f3n del artefacto, precisamente porque la tenencia se da dentro de su domicilio, sin que sea relevante que el arma de fuego sea de uso exclusivo de las fuerzas armadas, pues si bien la posesi\u00f3n no puede considerarse amparada bajo la previsi\u00f3n del art\u00edculo 10, lo cierto es que las caracter\u00edsticas del arma no var\u00edan la acci\u00f3n de posesi\u00f3n que dar\u00e1 lugar a la conducta delictiva.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El art\u00edculo 10 de la Constituci\u00f3n Federal prev\u00e9 el derecho de los habitantes de nuestro pa\u00eds a poseer armas en el domicilio, con un prop\u00f3sito de seguridad y leg\u00edtima defensa; exceptuado la posesi\u00f3n de armas prohibidas por la ley federal, as\u00ed como aquellas reservadas para el uso exclusivo de la Fuerza Armada Permanente y de los cuerpos de reserva<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">\u00c9poca: D\u00e9cima \u00c9poca.
