{"id":70715,"date":"2020-12-25T01:26:31","date_gmt":"2020-12-25T01:26:31","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70715"},"modified":"2020-12-25T01:26:31","modified_gmt":"2020-12-25T01:26:31","slug":"debe-garantizarse-el-derecho-de-los-menores-a-ser-escuchados-en-el-procedimiento-jurisdiccional-que-involucre-sus-derechos","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70715","title":{"rendered":"DEBE GARANTIZARSE EL DERECHO DE LOS MENORES A SER ESCUCHADOS EN EL PROCEDIMIENTO JURISDICCIONAL QUE INVOLUCRE SUS DERECHOS"},"content":{"rendered":"<p><strong>DEBE GARANTIZARSE EL DERECHO DE LOS MENORES A SER ESCUCHADOS EN EL PROCEDIMIENTO JURISDICCIONAL QUE INVOLUCRE SUS DERECHOS<\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p>La Suprema Corte de Justicia de la Naci\u00f3n, a trav\u00e9s de su Primera Sala, resolvi\u00f3 que se debe escuchar y atender a la opini\u00f3n de los menores de edad en los procesos jurisdiccionales que les conciernen, como parte de su derecho de acceso a la justicia, y es un elemento importante para la decisi\u00f3n que tomar\u00e1 el juzgador en torno a sus garant\u00edas.<\/p>\n<p>Por ello, a fin de alcanzar una justicia con perspectiva de infancia, las autoridades judiciales y sus auxiliares deben proveer la mejor forma de interactuar con el menor y alcanzar su libre opini\u00f3n, de acuerdo con sus a\u00f1os y grado de madurez (ciclos vitales: primera infancia, infancia y adolescencia); y nunca rechazar escucharlos s\u00f3lo por raz\u00f3n de su temprana edad.<\/p>\n<p>En una tesis publicada en el Semanario Judicial de la Federaci\u00f3n, la Sala estableci\u00f3 que ese derecho puede darse no s\u00f3lo con la implementaci\u00f3n de los mecanismos formales de los que participan las personas adultas como declaraciones testimoniales o escritas, sino a partir de metodolog\u00edas pedag\u00f3gicas y did\u00e1cticas que brinden condiciones adecuadas al ni\u00f1o, ni\u00f1a o adolescente para alcanzar ese objetivo, inclusive, comunic\u00e1ndole la decisi\u00f3n en forma clara y asertiva.<\/p>\n<p>El Tribunal Constitucional estim\u00f3 que el derecho de los menores de edad a emitir su opini\u00f3n y a ser escuchados en los procedimientos jurisdiccionales en que se ventilan sus garant\u00edas, se encuentra reconocido en el art\u00edculo 12 de la Convenci\u00f3n sobre los Derechos del Ni\u00f1o, e impl\u00edcitamente en el art\u00edculo 4o. de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, y de conformidad con los instrumentos e interpretaciones especializadas en materia de protecci\u00f3n de los derechos de la ni\u00f1ez, es uno de los principios rectores que se deben tomar en cuenta en todo proceso que les concierna.<\/p>\n<p>En el caso del que deriv\u00f3 esta tesis, el padre de un menor de edad en la primera etapa de la infancia, demand\u00f3 en su favor el cambio de la guardia y custodia de su hijo, en virtud de que la madre ejerci\u00f3 sobre \u00e9ste actos de violencia f\u00edsica. En su momento, se determin\u00f3 que la guarda y custodia del ni\u00f1o la deb\u00eda ejercer la madre; sin embargo, en el procedimiento no se escuch\u00f3 al menor de edad, aparentemente por raz<em>\u00f3n de su temprana edad.<\/em><\/p>\n<p><em>\u00c9poca: D\u00e9cima \u00c9poca.
