{"id":70625,"date":"2020-12-23T03:13:27","date_gmt":"2020-12-23T03:13:27","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70625"},"modified":"2020-12-23T03:13:27","modified_gmt":"2020-12-23T03:13:27","slug":"la-incidencia-de-castigos-corporales-en-la-asignacion-de-la-guarda-y-custodia-debe-determinarse-en-cada-caso-en-funcion-del-interes-superior-del-menor-de-edad","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70625","title":{"rendered":"LA INCIDENCIA DE CASTIGOS CORPORALES EN LA ASIGNACI\u00d3N DE LA GUARDA Y CUSTODIA DEBE DETERMINARSE EN CADA CASO EN FUNCI\u00d3N DEL INTER\u00c9S SUPERIOR DEL MENOR DE EDAD"},"content":{"rendered":"<p><strong>LA INCIDENCIA DE CASTIGOS CORPORALES EN LA ASIGNACI\u00d3N DE LA GUARDA Y CUSTODIA DEBE DETERMINARSE EN CADA CASO EN FUNCI\u00d3N DEL INTER\u00c9S SUPERIOR DEL MENOR DE EDAD<\/strong><\/p>\n<p><b>Por Redacci\u00f3n QP<\/b><\/p>\n<p>La Primera Sala de la Suprema Corte de Justicia de la Naci\u00f3n determin\u00f3 que la asignaci\u00f3n de la guarda y custodia de un menor de edad frente a un incidente de maltrato corporal debe decidirse atendiendo a todas las circunstancias del caso y en funci\u00f3n del inter\u00e9s superior del ni\u00f1o.<\/p>\n<p>La Sala consider\u00f3 que el acto o actos de violencia f\u00edsica no conducen en autom\u00e1tico a negar la funci\u00f3n de la guarda y custodia al progenitor que ejerci\u00f3 la violencia para otorgarla al otro, sino que se deben ponderar todos los elementos del caso, para garantizar que la decisi\u00f3n sobre qui\u00e9n ejercer\u00e1 sus cuidados y qui\u00e9n mantendr\u00e1 un r\u00e9gimen de convivencia con \u00e9l, sea el escenario de mayor beneficio para el menor de edad.<\/p>\n<p>En este caso, el padre del menor\u2014en la primera etapa de la infancia\u2014demand\u00f3 en su favor el cambio de la guarda y custodia de su hijo, en virtud de que la madre ejerci\u00f3 sobre \u00e9ste actos de violencia f\u00edsica, pero el \u00f3rgano de amparo estim\u00f3 que se trat\u00f3 de un acto aislado, realizado como una medida correctiva disciplinaria justificada, que no encuadraba en la definici\u00f3n de castigo corporal conforme a la doctrina del Comit\u00e9 de los Derechos del Ni\u00f1o.<\/p>\n<p><em>\u00c9poca: D\u00e9cima \u00c9poca.
