{"id":70565,"date":"2020-12-21T18:14:14","date_gmt":"2020-12-21T18:14:14","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70565"},"modified":"2020-12-21T18:14:14","modified_gmt":"2020-12-21T18:14:14","slug":"los-intereses-ordinarios-y-los-intereses-moratorios-no-deben-sumarse-como-si-fueran-elementos-similares-para-efectos-del-estudio-de-la-usura","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70565","title":{"rendered":"LOS INTERESES ORDINARIOS Y LOS INTERESES MORATORIOS NO DEBEN SUMARSE COMO SI FUERAN ELEMENTOS SIMILARES PARA EFECTOS DEL ESTUDIO DE LA USURA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LOS INTERESES ORDINARIOS Y LOS INTERESES MORATORIOS NO DEBEN SUMARSE COMO SI FUERAN ELEMENTOS SIMILARES PARA EFECTOS DEL ESTUDIO DE LA USURA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n, a trav\u00e9s de su Primera Sala, estableci\u00f3 que cuando por motivo de un cr\u00e9dito o pr\u00e9stamo de dinero se devengan simult\u00e1neamente intereses ordinarios y moratorios, su an\u00e1lisis debe realizarse respecto de cada tipo de inter\u00e9s en lo individual y no mediante la sumatoria de ambas tasas.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Sala determin\u00f3 que los intereses ordinarios y los intereses moratorios no deben sumarse como si fueran elementos similares para efectos del estudio de la usura, pues hacerlo implicar\u00eda incurrir en la falacia de la falsa analog\u00eda o equivalencia, mediante la comparaci\u00f3n de elementos que, si bien pueden parecer similares, en la realidad distan de serlo.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">As\u00ed, los intereses ordinarios consisten en el r\u00e9dito o ganancia que produce o debe producir el dinero prestado, por el simple hecho de que una persona dio a otra una cantidad de dinero para satisfacer sus propias necesidades.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por ello, se afirma que, al momento de regresar el dinero prestado, es cuando cesa la obligaci\u00f3n del deudor de cubrir los intereses respectivos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Mientras que los intereses moratorios, consisten en la sanci\u00f3n que se impone por la entrega tard\u00eda del dinero, de acuerdo con lo pactado o lo establecido en la norma legal; de modo que, si no se entrega el dinero prestado en la fecha estipulada, surge el derecho del titular del dinero para que se le sancione al deudor por su incumplimiento, imponi\u00e9ndole una carga por su tardanza.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">De acuerdo con su naturaleza jur\u00eddica, los intereses moratorios son provenientes del incumplimiento en el pago del pr\u00e9stamo.<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">\u00c9poca: D\u00e9cima \u00c9poca.
