{"id":70113,"date":"2020-12-11T04:34:41","date_gmt":"2020-12-11T04:34:41","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70113"},"modified":"2020-12-11T04:34:41","modified_gmt":"2020-12-11T04:34:41","slug":"scjn-aprueba-extender-la-prorroga-del-plazo-concedido-al-congreso-de-la-union-en-la-declaratoria-general-de-inconstitucionalidad-1-2018-relativa-a-la-despenalizacion-del-uso-ludico-de-la-marihuana","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70113","title":{"rendered":"SCJN APRUEBA EXTENDER LA PR\u00d3RROGA DEL PLAZO CONCEDIDO AL CONGRESO DE LA UNI\u00d3N EN LA DECLARATORIA GENERAL DE INCONSTITUCIONALIDAD 1\/2018 RELATIVA A LA DESPENALIZACI\u00d3N DEL USO L\u00daDICO DE LA MARIHUANA"},"content":{"rendered":"<p><strong>SCJN APRUEBA EXTENDER LA PR\u00d3RROGA DEL PLAZO CONCEDIDO AL CONGRESO DE LA UNI\u00d3N EN LA DECLARATORIA GENERAL DE INCONSTITUCIONALIDAD 1\/2018 RELATIVA A LA DESPENALIZACI\u00d3N DEL USO L\u00daDICO DE LA MARIHUANA<\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p>La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n privada remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia, aprob\u00f3 extender la pr\u00f3rroga del plazo establecido en el art\u00edculo 107, fracci\u00f3n II, p\u00e1rrafo tercero, de la Constituci\u00f3n Federal, respecto de la Declaratoria General de Inconstitucionalidad 1\/2018, otorgada originalmente al Congreso de la Uni\u00f3n por el Pleno del Alto Tribunal, el 29 de octubre de 2019.<\/p>\n<p>Dicha declaratoria se\u00f1ala que es inconstitucional la prohibici\u00f3n absoluta al consumo l\u00fadico o recreativo de marihuana prevista por la Ley General de Salud; que la prohibici\u00f3n absoluta del consumo l\u00fadico de marihuana no es una medida necesaria para proteger la salud y el orden p\u00fablico; y que la prohibici\u00f3n absoluta del consumo l\u00fadico de marihuana no es una medida proporcional para proteger la salud y el orden p\u00fablico. Por los anteriores motivos, el Congreso de la Uni\u00f3n deber\u00e1 llevar a cabo las reformas correspondientes.<\/p>\n<p>El Pleno del Alto Tribunal aprob\u00f3 dicha pr\u00f3rroga en atenci\u00f3n a la situaci\u00f3n derivada de la emergencia sanitaria ocasionada por el COVID-19, as\u00ed como a la necesidad de que la C\u00e1mara de Diputados del Congreso de la Uni\u00f3n cuente con el tiempo
