{"id":70009,"date":"2020-12-09T03:43:14","date_gmt":"2020-12-09T03:43:14","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70009"},"modified":"2020-12-09T03:43:14","modified_gmt":"2020-12-09T03:43:14","slug":"scjn-invalida-diversas-disposiciones-de-las-leyes-de-ingresos-municipales-del-estado-de-veracruz-que-preveian-el-cobro-de-derechos-por-expedicion-de-copias-y-registro-extemporaneo-de-nacimiento","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70009","title":{"rendered":"SCJN INVALIDA DIVERSAS DISPOSICIONES DE LAS LEYES DE INGRESOS MUNICIPALES DEL ESTADO DE VERACRUZ, QUE PREVE\u00cdAN EL COBRO DE DERECHOS POR EXPEDICI\u00d3N DE COPIAS Y REGISTRO EXTEMPOR\u00c1NEO DE NACIMIENTO"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">SCJN INVALIDA DIVERSAS DISPOSICIONES DE LAS LEYES DE INGRESOS MUNICIPALES DEL ESTADO DE VERACRUZ, QUE PREVE\u00cdAN EL COBRO DE DERECHOS POR EXPEDICI\u00d3N DE COPIAS Y REGISTRO EXTEMPOR\u00c1NEO DE NACIMIENTO<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 los preceptos de las Leyes de Ingresos de diversos municipios del Estado de Veracruz, donde se establec\u00edan cuotas por concepto de expedici\u00f3n de copias, por vulnerar el principio de proporcionalidad tributaria al no tener una base objetiva y razonable que se basara en el costo de los insumos utilizados para la prestaci\u00f3n del servicio. Al respecto, se destac\u00f3 que las normas invalidadas tambi\u00e9n contraven\u00edan el principio de seguridad jur\u00eddica por establecer un par\u00e1metro m\u00ednimo y m\u00e1ximo para el cobro del derecho por la certificaci\u00f3n de documentos, adem\u00e1s de que preve\u00edan una cuota por la b\u00fasqueda de estos cuando el interesado no proporcionara los datos exactos para su localizaci\u00f3n.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, declar\u00f3 la invalidez de las disposiciones en las que se establec\u00eda el cobro por la expedici\u00f3n de copias simples, certificadas e impresiones, solicitadas en el contexto de un procedimiento de transparencia, pues dichos preceptos vulneraban el principio de gratuidad del acceso a la informaci\u00f3n p\u00fablica contenido en el art\u00edculo 6 de la Constituci\u00f3n General.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Finalmente, la SCJN invalid\u00f3 el art\u00edculo 12, en la porci\u00f3n normativa \u201cRegistro de nacimientos extempor\u00e1neos 1.5\u201d, de la Ley de Ingresos del Municipio de Minatitl\u00e1n, por vulnerar el derecho a la gratuidad del registro de nacimiento y a la expedici\u00f3n de la primera copia certificada del acta respectiva.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 105\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez de diversas disposiciones de Leyes de Ingresos municipales del Estado de Veracruz de Ignacio de la Llave, para el ejercicio fiscal de 2020, publicadas en la Gaceta Oficial de esa entidad de 31 de diciembre de 2019.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>SCJN INVALIDA DIVERSAS DISPOSICIONES DE LAS LEYES DE INGRESOS MUNICIPALES DEL ESTADO DE VERACRUZ,
