{"id":70005,"date":"2020-12-09T03:25:41","date_gmt":"2020-12-09T03:25:41","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=70005"},"modified":"2020-12-09T03:25:41","modified_gmt":"2020-12-09T03:25:41","slug":"los-congresos-locales-deben-exponer-una-motivacion-razonable-si-se-separan-de-las-propuestas-de-leyes-de-ingresos-presentadas-por-los-municipios","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=70005","title":{"rendered":"LOS CONGRESOS LOCALES DEBEN EXPONER UNA MOTIVACI\u00d3N RAZONABLE SI SE SEPARAN DE LAS PROPUESTAS DE LEYES DE INGRESOS PRESENTADAS POR LOS MUNICIPIOS"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LOS CONGRESOS LOCALES DEBEN EXPONER UNA MOTIVACI\u00d3N RAZONABLE SI SE SEPARAN DE LAS PROPUESTAS DE LEYES DE INGRESOS PRESENTADAS POR LOS MUNICIPIOS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, determin\u00f3 que en el proceso legislativo del que deriv\u00f3 la Ley 132, de Ingresos y Presupuesto de Ingresos del Ayuntamiento del Municipio de la Heroica Nogales, Sonora, para el ejercicio fiscal de 2020, no existieron violaciones con car\u00e1cter invalidante.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La SCJN estableci\u00f3 que, contrario a lo argumentado por el Municipio de Nogales, no se elimin\u00f3 de la Ley de Ingresos aprobada por el Congreso Local, el pago de derechos por servicios en materia de control sanitario de animales dom\u00e9sticos que presten los centros antirr\u00e1bicos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, el Pleno determin\u00f3 que el Congreso Local viol\u00f3 lo dispuesto en el art\u00edculo 115, fracci\u00f3n IV, de la Constituci\u00f3n General, al no exponer de manera objetiva y razonable los motivos por los cuales se apart\u00f3 de la propuesta de Ley de Ingresos enviada por el Municipio actor, respecto de diversos preceptos relativos al cobro de derechos por servicios catastrales, por servicios prestados a los establecimientos mercantiles y a aqu\u00e9llos donde operan m\u00e1quinas electr\u00f3nicas de juego con sorteo de n\u00fameros y apuestas. La SCJN determin\u00f3 que el Congreso de Sonora deber\u00e1 pronunciarse de manera motivada, razonada, objetiva y congruente respecto de la propuesta del Municipio actor.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Finalmente, la SCJN consider\u00f3 que a pesar de que se eliminaron diversos conceptos de pago de la Ley de Ingresos municipal, se mantuvo el importe total del presupuesto contenido en la iniciativa y aprobado por el Congreso local. Por tal motivo, el Pleno declar\u00f3 la invalidez de la porci\u00f3n normativa que establece dicho importe.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Controversia constitucional 23\/2020, promovida por el Municipio de Nogales, Sonora, en contra de los Poderes Legislativo y Ejecutivo de esa entidad, demandando la invalidez del proceso legislativo del que deriv\u00f3 la Ley 132 de Ingresos y Presupuesto de Ingresos del Ayuntamiento de dicho municipio, para el ejercicio fiscal de 2020, publicada el 27 de
