{"id":69940,"date":"2020-12-07T23:50:11","date_gmt":"2020-12-07T23:50:11","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=69940"},"modified":"2020-12-07T23:50:11","modified_gmt":"2020-12-07T23:50:11","slug":"invalida-scjn-diversos-articulos-de-la-ley-de-instituciones-y-procedimientos-electorales-del-estado-de-campeche-por-restringir-la-libertad-de-expresion-de-los-partidos-politicos-y-hacer-nugatoria-proh","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69940","title":{"rendered":"INVALIDA SCJN DIVERSOS ART\u00cdCULOS DE LA LEY DE INSTITUCIONES Y PROCEDIMIENTOS ELECTORALES DEL ESTADO DE CAMPECHE POR RESTRINGIR LA LIBERTAD DE EXPRESI\u00d3N DE LOS PARTIDOS POL\u00cdTICOS Y HACER NUGATORIA PROHIBICI\u00d3N DE INDUCIR EL VOTO A CAMBIO DE D\u00c1DIVAS"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">INVALIDA SCJN DIVERSOS ART\u00cdCULOS DE LA LEY DE INSTITUCIONES Y PROCEDIMIENTOS ELECTORALES DEL ESTADO DE CAMPECHE POR RESTRINGIR LA LIBERTAD DE EXPRESI\u00d3N DE LOS PARTIDOS POL\u00cdTICOS Y HACER NUGATORIA PROHIBICI\u00d3N DE INDUCIR EL VOTO A CAMBIO DE D\u00c1DIVAS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia analiz\u00f3 una acci\u00f3n de inconstitucionalidad promovida por un partido pol\u00edtico nacional en contra de diversos art\u00edculos de la Ley de Instituciones y Procedimientos Electorales del Estado de Campeche.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, en primer lugar, declar\u00f3 la inconstitucionalidad de una porci\u00f3n normativa del art\u00edculo 583 que establec\u00eda como infracci\u00f3n de los partidos pol\u00edticos la difusi\u00f3n de propaganda que denigrara a las instituciones y a los propios partidos. Ello, al estimar que la Constituci\u00f3n \u00fanicamente protege a las personas contra la calumnia. As\u00ed, se trata de una restricci\u00f3n a la libertad de expresi\u00f3n de los partidos pol\u00edticos que no encuentra justificaci\u00f3n en el texto constitucional. De igual forma, declar\u00f3 la invalidez del tercer p\u00e1rrafo del art\u00edculo 612, en atenci\u00f3n a que defin\u00eda la calumnia como la imputaci\u00f3n de hechos o delitos falsos, sin incluir un elemento fundamental del concepto, esto es, que la imputaci\u00f3n debe hacerse a sabiendas de que el hecho o delito es falso.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En tercer lugar, declar\u00f3 la inconstitucionalidad de una porci\u00f3n normativa que prohib\u00eda entregar material que ofertara o entregara alg\u00fan beneficio como presi\u00f3n al electorado para obtener su voto, ello, porque estaba condicionado a que los materiales entregados tuvieran propaganda pol\u00edtica o electoral de partidos, coaliciones o candidatos. As\u00ed, dicha porci\u00f3n hac\u00eda nugatoria la prohibici\u00f3n de inducir el voto a cambio de d\u00e1divas, por condicionarlo a que los materiales entregados ostentaran propaganda alusiva al partido o candidato que con ellas se pretendiera promocionar.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 134\/2020, promovida por el partido pol\u00edtico MORENA, demandando la invalidez del Decreto 134, mediante el cual se reformaron, adicionaron y derogaron diversas disposiciones de la Ley de Instituciones y Procedimientos Electorales del Estado de Campeche, publicado en el Peri\u00f3dico Oficial de esa entidad el 29 de mayo de 2020.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>INVALIDA SCJN DIVERSOS ART\u00cdCULOS DE LA LEY DE INSTITUCIONES Y PROCEDIMIENTOS ELECTORALES DEL ESTADO
