data-originalcomputedfontsize=\"16\">LA SCJN DECLARA LA INVALIDEZ TOTAL DEL DECRETO 580 DEL ESTADO DE VERACRUZ, RELATIVO A LA REFORMA, ADICI\u00d3N Y DEROGACI\u00d3N DE DIVERSAS NORMAS EN MATERIA ELECTORAL, POR HABERSE EMITIDO SIN QUE, DE MANERA PREVIA, SE HUBIERA CONSULTADO A LOS PUEBLOS Y COMUNIDADES IND\u00cdGENAS Y AFROMEXICANAS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia, declar\u00f3 la invalidez total del Decreto 580 por el que se reforman, adicionan y derogan diversas disposiciones del C\u00f3digo Electoral y se reforman los art\u00edculos 22 y 171 de la Ley Org\u00e1nica del Municipio Libre, ambos ordenamientos del Estado de Veracruz, publicado el 28 de julio de 2020. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El Pleno reiter\u00f3 su l\u00ednea de precedentes y determin\u00f3 que el contenido del decreto impugnado incid\u00eda directamente en los intereses de los pueblos y comunidades ind\u00edgenas del Estado, por lo que, conforme a los art\u00edculos 2\u00b0 de la Constituci\u00f3n General y 6 del Convenio 169 de la OIT, las autoridades locales se encontraban obligadas a realizar una consulta de forma previa, libre, informada, culturalmente adecuada y de buena fe en la que participaran dichos grupos. <\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Como consecuencia de la declaraci\u00f3n de invalidez, se orden\u00f3 el restablecimiento de la vigencia de las normas anteriores a las reformadas; se determin\u00f3 que la consulta respectiva deber\u00e1 realizarse y la nueva legislaci\u00f3n emitirse, a m\u00e1s tardar, dentro de un a\u00f1o siguiente a la conclusi\u00f3n del proceso electoral del Estado de Veracruz; y que, para garantizar el principio de certeza respecto de las normas aplicables al proceso electoral pr\u00f3ximo, la invalidez debe hacerse extensiva al diverso Decreto 594 por el que se reformaron, adicionaron y derogaron diversas disposiciones del C\u00f3digo Electoral para dicha entidad federativa, publicado el 1 de octubre del a\u00f1o en curso,\u00a0 aun cuando no hubiera sido impugnado.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acciones de inconstitucionalidad 241\/2020 y sus acumuladas 242\/2020, 243\/2020, 248\/2020 y 251\/2020, promovidas por los partidos pol\u00edticos de la Revoluci\u00f3n Democr\u00e1tica, Revolucionario Institucional, Acci\u00f3n Nacional, Movimiento Ciudadano y Local Unidad Ciudadana del Estado de Veracruz de Ignacio de la Llave, demandando la invalidez del Decreto 580 por el que se reforman, adicionan y derogan diversas disposiciones del C\u00f3digo Electoral y la Ley Org\u00e1nica del Municipio Libre del mencionado Estado, y del Decreto 576 por el que se reforman, adicionan y derogan diversas disposiciones de la Constituci\u00f3n Pol\u00edtica de esa entidad, publicados, respectivamente, en la Gaceta Oficial local el 28 de julio y el 22 de junio de 2020.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LA
