{"id":69698,"date":"2020-12-02T00:53:16","date_gmt":"2020-12-02T00:53:16","guid":{"rendered":"https:\/\/quehacerpolitico.mx\/?p=69698"},"modified":"2020-12-02T00:53:16","modified_gmt":"2020-12-02T00:53:16","slug":"los-tribunales-electorales-de-los-estados-deben-estar-integrados-por-un-numero-impar-de-magistrados","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69698","title":{"rendered":"LOS TRIBUNALES ELECTORALES DE LOS ESTADOS DEBEN ESTAR INTEGRADOS POR UN N\u00daMERO IMPAR DE MAGISTRADOS"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LOS TRIBUNALES ELECTORALES DE LOS ESTADOS DEBEN ESTAR INTEGRADOS POR UN N\u00daMERO IMPAR DE MAGISTRADOS<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, realizada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 una porci\u00f3n del art\u00edculo S\u00e9ptimo Transitorio del Decreto 103, que reform\u00f3 la Constituci\u00f3n Pol\u00edtica del Estado de Nayarit, por medio de la cual se hab\u00eda establecido una integraci\u00f3n temporal del Tribunal Electoral local, de cuatro magistrados.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Dicha reforma se inscribe en la decisi\u00f3n del \u00d3rgano Reformador de la Constituci\u00f3n de Nayarit de reducir la integraci\u00f3n de dicho tribunal de cinco magistrados a tres magistrados. La porci\u00f3n invalidada de dicho art\u00edculo, era una norma de tr\u00e1nsito que regulaba: \u201c; a partir del 16 de diciembre de 2019 y hasta el 16 de diciembre de 2021, la integraci\u00f3n del Tribunal Estatal Electoral de Nayarit ser\u00e1 de cuatro Magistrados\u201d.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La SCJN determin\u00f3 que la porci\u00f3n normativa invalidada resultaba violatoria de lo dispuesto en el art\u00edculo 116, fracci\u00f3n IV, inciso c), numeral 5o., de la Constituci\u00f3n Federal, donde se establece que las autoridades electorales jurisdiccionales de los estados se integrar\u00e1n por un n\u00famero impar de magistrados.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Si bien la reforma invalidada era una medida temporal y de transici\u00f3n, cuyo objetivo era reducir el n\u00famero de integrantes del Tribunal Electoral de cinco a tres magistrados, en la que se buscaba no afectar a la magistrada y los magistrados que por virtud de su nombramiento original a\u00fan se desempe\u00f1an en el cargo, el Pleno determin\u00f3 que no puede haber excepci\u00f3n alguna a la prohibici\u00f3n de integraci\u00f3n en n\u00famero par, ni siquiera trat\u00e1ndose de una reforma con esos objetivos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Por el contrario, el Pleno de la SCJN valid\u00f3 los art\u00edculos 135, apartado D, p\u00e1rrafo cuarto, as\u00ed como Sexto y S\u00e9ptimo Transitorios \u2013salvo en la porci\u00f3n invalidada del \u00faltimo\u2013, de la Constituci\u00f3n Pol\u00edtica local, relativos a la reducci\u00f3n del n\u00famero de magistrados de cinco a tres del Tribunal Estatal Electoral y al sistema de medios de impugnaci\u00f3n, al considerar que no resultan violatorios de lo dispuesto en la Constituci\u00f3n Federal y que no implican una invasi\u00f3n a la competencia del Senado de la Rep\u00fablica para la designaci\u00f3n de los magistrados del se\u00f1alado \u00f3rgano jurisdiccional, ni eran violatorios del principio de no regresividad en relaci\u00f3n con la independencia judicial.<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 142\/2019, promovida por el Partido del Trabajo, demandando la invalidez de diversas disposiciones de la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Nayarit, reformada mediante Decreto 103, publicado en el Peri\u00f3dico Oficial de esa entidad de 26 de noviembre de 2019<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LOS TRIBUNALES ELECTORALES DE LOS
