data-originalcomputedfontsize=\"16\">INVALIDA SCJN LEY DE INGRESOS Y PRESUPUESTO DE EGRESOS DEL ESTADO DE MORELOS PARA EL EJERCICIO FISCAL 2020 POR VIOLACIONES AL PROCESO LEGISLATIVO<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 la Ley de Ingresos y el Decreto n\u00famero 661, por el que se aprob\u00f3 el Presupuesto de Egresos, ambos del Estado de Morelos para el ejercicio fiscal 2020, al haber sido aprobados fuera de los periodos ordinarios de sesiones del Congreso local y sin que hubiera sido convocada para el efecto una sesi\u00f3n extraordinaria.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El Pleno de la SCJN consider\u00f3 que en virtud de que los ordenamientos impugnados no fueron aprobados observando las formalidades y plazos claramente consignados en la Constituci\u00f3n, la Ley Org\u00e1nica y el Reglamento del Congreso del Estado de Morelos; y si bien, la inobservancia a esa normativa no afect\u00f3 el debate parlamentario, ni el producto final, es decir, los ordenamientos cuestionados, tambi\u00e9n lo es que la existencia de periodos espec\u00edficos de duraci\u00f3n de sesiones ordinarias tiene como objetivo que, en ese espacio de tiempo, el Congreso ejerza sus atribuciones, dando validez a sus actos jur\u00eddicos y respetando al principio de seguridad jur\u00eddica.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La invalidez decretada no tendr\u00e1 efectos retroactivos y, a partir de que sean notificados los puntos resolutivos de la sentencia al Congreso de Morelos, deber\u00e1n aplicarse la Ley de Ingresos y el Presupuesto de Egresos del Estado del ejercicio fiscal 2019.<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 116\/2020, promovida por la Comisi\u00f3n de Derechos Humanos del Estado de Morelos, demandando la invalidez de la Ley de Ingresos y el Decreto 661 por el que se aprueba el Presupuesto de Egresos, ambas del Estado de Morelos, para el ejercicio fiscal de 2020, publicadas en el Peri\u00f3dico Oficial de esa entidad el 29 de enero de 2020.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>INVALIDA SCJN LEY DE INGRESOS Y
