{"id":69538,"date":"2020-11-25T21:50:29","date_gmt":"2020-11-26T03:50:29","guid":{"rendered":"http:\/\/quehacerpolitico.mx\/?p=69538"},"modified":"2020-11-25T21:50:29","modified_gmt":"2020-11-26T03:50:29","slug":"la-comercializacion-de-los-aparatos-denominados-cigarros-electronicos-es-legalmente-posible-unicamente-cuando-su-funcionamiento-sea-para-el-uso-de-productos-del-tabaco-segunda-sala","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69538","title":{"rendered":"LA COMERCIALIZACI\u00d3N DE LOS APARATOS DENOMINADOS \u201cCIGARROS ELECTR\u00d3NICOS\u201d ES LEGALMENTE POSIBLE \u00daNICAMENTE CUANDO SU FUNCIONAMIENTO SEA PARA EL USO DE PRODUCTOS DEL TABACO: SEGUNDA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LA COMERCIALIZACI\u00d3N DE LOS APARATOS DENOMINADOS \u201cCIGARROS ELECTR\u00d3NICOS\u201d ES LEGALMENTE POSIBLE \u00daNICAMENTE CUANDO SU FUNCIONAMIENTO SEA PARA EL USO DE PRODUCTOS DEL TABACO: SEGUNDA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Segunda Sala, al conocer de un asunto relacionado con la prohibici\u00f3n de comercializar cigarros electr\u00f3nicos concluy\u00f3 que:<\/span><\/p>\n<ul>\n<li><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\"> La fracci\u00f3n VI del art\u00edculo 16 de la Ley General para el Control del Tabaco es respetuosa del orden constitucional en la medida que la prohibici\u00f3n de comercializaci\u00f3n all\u00ed contenida \u00fanicamente se refiere a productos que no son del tabaco.<\/span><\/li>\n<li><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\"> La Sala tom\u00f3 en cuenta como base las pautas internacionales determinadas por la Organizaci\u00f3n Mundial de la Salud, y por eso distingui\u00f3 que entre los diversos aparatos que pueden ser comprendidos como \u201ccigarro electr\u00f3nico\u201d, se precis\u00f3 que aquellos que funcionan s\u00f3lo con productos del tabaco pueden ser comercializados bajo las condiciones establecidas en la Ley General para el Control del Tabaco.<\/span><\/li>\n<li><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\"> De igual forma, la Segunda Sala determin\u00f3 que no puede hacerse la comercializaci\u00f3n de dispositivos electr\u00f3nicos (lo que comprende aquellos coloquialmente conocidos como vapers) que emplean para su funcionamiento sustancias distintas al tabaco, respecto de los cuales, adem\u00e1s, debe privar una tutela precautoria del derecho fundamental a la salud.<\/span><\/li>\n<\/ul>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Amparo en Revisi\u00f3n 853\/2019.
