{"id":69526,"date":"2020-11-25T20:48:45","date_gmt":"2020-11-26T02:48:45","guid":{"rendered":"http:\/\/quehacerpolitico.mx\/?p=69526"},"modified":"2020-11-25T20:48:45","modified_gmt":"2020-11-26T02:48:45","slug":"en-el-juicio-de-alimentos-entre-conyuges-es-improcedente-el-otorgamiento-de-pension-compensatoria-si-durante-la-tramitacion-de-este-se-disuelve-el-vinculo-matrimonial-primera-sala","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69526","title":{"rendered":"EN EL JUICIO DE ALIMENTOS ENTRE C\u00d3NYUGES, ES IMPROCEDENTE EL OTORGAMIENTO DE PENSI\u00d3N COMPENSATORIA SI, DURANTE LA TRAMITACI\u00d3N DE \u00c9STE, SE DISUELVE EL V\u00cdNCULO MATRIMONIAL: PRIMERA SALA"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">EN EL JUICIO DE ALIMENTOS ENTRE C\u00d3NYUGES, ES IMPROCEDENTE EL OTORGAMIENTO DE PENSI\u00d3N COMPENSATORIA SI, DURANTE LA TRAMITACI\u00d3N DE \u00c9STE, SE DISUELVE EL V\u00cdNCULO MATRIMONIAL: PRIMERA SALA<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota de Primera Sala, determin\u00f3 que, si durante el proceso del juicio de alimentos entre c\u00f3nyuges, se acredita que el v\u00ednculo matrimonial se disolvi\u00f3, no es factible declarar procedente la pensi\u00f3n compensatoria en ese mismo juicio, por lo que tendr\u00eda que analizarse en uno diferente en el que se valoren adecuadamente las nuevas consideraciones f\u00e1cticas y jur\u00eddicas en beneficio de ambas partes.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En el caso, al resolver una contradicci\u00f3n de tesis, la Sala sostuvo que la obligaci\u00f3n de alimentos, derivada de las relaciones de matrimonio y concubinato, surge como parte de los deberes de solidaridad y asistencia mutuos. Mientras que la pensi\u00f3n compensatoria encuentra su raz\u00f3n de ser en un deber asistencial y resarcitorio, derivado del desequilibrio econ\u00f3mico que suele presentarse entre los c\u00f3nyuges al momento de disolverse el v\u00ednculo matrimonial.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Al respecto, la Sala indic\u00f3 que la obligaci\u00f3n de alimentos que surge a partir del matrimonio o concubinato termina una vez que se disuelve el v\u00ednculo matrimonial, o bien se da por terminado el concubinato o uni\u00f3n de hecho. Por consiguiente, si cuando se inici\u00f3 el juicio de alimentos estaba vigente la relaci\u00f3n y durante la tramitaci\u00f3n de \u00e9ste, se disuelve, ya no existe materia en el juicio.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Asimismo, la Sala advirti\u00f3 que quienes conozcan de los juicios de divorcio (en casos de matrimonio) deben analizar la procedencia de la pensi\u00f3n compensatoria en suplencia de la queja y que dicha cuesti\u00f3n se enmarca en la obligaci\u00f3n de juzgar con perspectiva de g\u00e9nero; por ello indic\u00f3 que, si lo anterior no es analizado en el juicio de divorcio, se habilita al exc\u00f3nyuge que lo requiera, a reclamar su pago en un juicio aut\u00f3nomo.<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Contradicci\u00f3n de tesis 530\/2019.
