{"id":69521,"date":"2020-11-25T20:20:41","date_gmt":"2020-11-26T02:20:41","guid":{"rendered":"http:\/\/quehacerpolitico.mx\/?p=69521"},"modified":"2020-11-25T20:20:41","modified_gmt":"2020-11-26T02:20:41","slug":"la-primera-sala-ordena-admitir-un-asunto-que-permitira-fijar-criterios-relacionados-entre-otros-con-el-interes-superior-de-menor-victima-de-delito-de-caracter-sexual","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69521","title":{"rendered":"LA PRIMERA SALA ORDENA ADMITIR UN ASUNTO QUE PERMITIR\u00c1 FIJAR CRITERIOS RELACIONADOS, ENTRE OTROS, CON EL INTER\u00c9S SUPERIOR DE MENOR V\u00cdCTIMA DE DELITO DE CAR\u00c1CTER SEXUAL"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">LA PRIMERA SALA ORDENA ADMITIR UN ASUNTO QUE PERMITIR\u00c1 FIJAR CRITERIOS RELACIONADOS, ENTRE OTROS, CON EL INTER\u00c9S SUPERIOR DE MENOR V\u00cdCTIMA DE DELITO DE CAR\u00c1CTER SEXUAL<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota de la Primera Sala, determin\u00f3 conocer de un amparo directo en revisi\u00f3n cuya resoluci\u00f3n permitir\u00e1 fijar criterios en relaci\u00f3n a diversos temas de car\u00e1cter constitucional como son: recurso efectivo, suplencia de queja, inter\u00e9s superior de menor y perspectiva de g\u00e9nero en el recurso de apelaci\u00f3n trat\u00e1ndose de v\u00edctima menor de delito de car\u00e1cter sexual.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El caso emana de un proceso penal en cuya sentencia se absolvi\u00f3 a la probable responsable del delito de violaci\u00f3n equiparada con punibilidad agravada, cometido contra una menor de edad. Inconformes con esa decisi\u00f3n la madre de la menor y el Ministerio P\u00fablico interpusieron recurso de apelaci\u00f3n cuya resoluci\u00f3n confirm\u00f3 la sentencia del juez de primera instancia.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Contra esa resoluci\u00f3n, la madre de la menor, en representaci\u00f3n de esta \u00faltima, promovi\u00f3 amparo directo cuyo fallo neg\u00f3 la protecci\u00f3n constitucional y declar\u00f3 legal la sentencia combatida, por lo que la quejosa interpuso recurso de revisi\u00f3n alegando, afectaci\u00f3n al derecho de tutela judicial efectiva, en su vertiente de acceso a un recurso efectivo, violaci\u00f3n a inter\u00e9s superior de menor cuando es v\u00edctima de un delito sexual y falta de an\u00e1lisis de estos casos con perspectiva de g\u00e9nero.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Primera Sala decidi\u00f3 admitir el recurso al advertir que, de los conceptos de violaci\u00f3n formulados en la demanda de amparo y de la sentencia recurrida, subsisten los t\u00f3picos de car\u00e1cter constitucional que plante\u00f3 la recurrente, los cuales son de la mayor relevancia jur\u00eddica en la agenda de este Alto Tribunal para continuar en la creaci\u00f3n de doctrina trat\u00e1ndose de casos de menores v\u00edctimas de delitos sexuales.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">En efecto, conforme a la competencia constitucional, la Sala observ\u00f3 que es necesario que la interpretaci\u00f3n constitucional sobre la obligaci\u00f3n de los \u00f3rganos jurisdiccionales de juzgar con perspectiva de g\u00e9nero, as\u00ed como velar en todo momento por el inter\u00e9s superior del menor cuando es v\u00edctima de un delito, dictando de oficio todas las providencias necesarias para esclarecer los hechos y lograr el bienestar del menor, sea analizada por la Sala, pues ello permitir\u00e1 revisar si la interpretaci\u00f3n realizada por el Tribunal Colegiado se encuentra ajustada a la doctrina y criterios ya emitidos por el Alto Tribunal del pa\u00eds, en particular trat\u00e1ndose de delitos de violencia sexual contra menores de edad.<\/span><\/p>\n<p><em><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Recurso de Reclamaci\u00f3n 746\/2020.
