{"id":69425,"date":"2020-11-23T18:18:12","date_gmt":"2020-11-24T00:18:12","guid":{"rendered":"http:\/\/quehacerpolitico.mx\/?p=69425"},"modified":"2020-11-23T18:18:12","modified_gmt":"2020-11-24T00:18:12","slug":"la-scjn-invalida-diversas-disposiciones-previstas-en-leyes-de-ingresos-municipales-del-estado-de-tamaulipas-que-establecian-el-cobro-por-la-prestacion-de-servicios-de-alumbrado-publico-busqueda-de-in","status":"publish","type":"post","link":"https:\/\/quehacerpolitico.mx\/?p=69425","title":{"rendered":"LA SCJN INVALIDA DIVERSAS DISPOSICIONES PREVISTAS EN LEYES DE INGRESOS MUNICIPALES DEL ESTADO DE TAMAULIPAS QUE ESTABLEC\u00cdAN EL COBRO POR LA PRESTACI\u00d3N DE SERVICIOS DE ALUMBRADO P\u00daBLICO, B\u00daSQUEDA DE INFORMACI\u00d3N Y ENTREGA DE COPIAS"},"content":{"rendered":"<p class=\"s14\"><span class=\"s13\"><span class=\"bumpedFont15\">LA SCJN INVALIDA DIVERSAS DISPOSICIONES PREVISTAS EN LEYES DE INGRESOS MUNICIPALES DEL ESTADO DE TAMAULIPAS QUE ESTABLEC\u00cdAN EL COBRO POR LA PRESTACI\u00d3N DE SERVICIOS DE ALUMBRADO P\u00daBLICO, B\u00daSQUEDA DE INFORMACI\u00d3N Y ENTREGA DE COPIAS<\/span><\/span><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p class=\"s15\"><span class=\"s12\"><span class=\"bumpedFont15\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 diferentes art\u00edculos de diversas Leyes de Ingresos de municipios del Estado de Tamaulipas, para el ejercicio fiscal de 2020.<\/span><\/span><\/p>\n<p class=\"s15\"><span class=\"s12\"><span class=\"bumpedFont15\">El Tribunal Pleno determin\u00f3, en primer lugar, que las normas que establec\u00edan el cobro por la prestaci\u00f3n del servicio de alumbrado p\u00fablico transgred\u00edan los principios tributarios de proporcionalidad y equidad, al fijar el monto del derecho a partir de circunstancias ajenas al costo del servicio, esto es, considerando el \u201ctotal de metros de frente a la v\u00eda p\u00fablica de todos los predios\u201d. Adem\u00e1s, se\u00f1al\u00f3 que dichas normas generaban incertidumbre en los contribuyentes dada la amplitud de sus disposiciones, pues el legislador no precis\u00f3 si se trataba del universo de predios del municipio o s\u00f3lo del barrio, colonia, poblaci\u00f3n espec\u00edfica u otra circunscripci\u00f3n territorial.<\/span><\/span><\/p>\n<p class=\"s15\"><span class=\"s12\"><span class=\"bumpedFont15\">Por otro lado, se invalidaron los preceptos que establec\u00edan el cobro por el servicio de \u201cb\u00fasqueda\u201d, por vulnerar el principio de gratuidad en el acceso a la informaci\u00f3n; y, los art\u00edculos que establec\u00edan el cobro por su entrega en copias simples, certificadas y medios t\u00e9cnicos, por considerar que las normas no se establecieron en funci\u00f3n de una base objetiva y razonable que se basara en la consideraci\u00f3n de los insumos utilizados, adem\u00e1s que el Congreso local no motiv\u00f3 la imposici\u00f3n del cobro establecido.<\/span><\/span><\/p>\n<p class=\"s15\"><span class=\"s16\"><span class=\"bumpedFont15\">Acci\u00f3n de inconstitucionalidad 21\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez de diversas disposiciones de Leyes de Ingresos Municipales del Estado de Tamaulipas, para el ejercicio fiscal de 2020, publicadas en el Peri\u00f3dico Oficial
