class=\"bumpedFont15\">LA INHABILITACI\u00d3N PERPETUA ES UNA PENA EXCESIVA Y DESPROPORCIONAL QUE VIOLA LA CONSTITUCI\u00d3N GENERAL DE LA REP\u00daBLICA<\/span><\/span><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 el art\u00edculo 144, fracci\u00f3n IV, inciso b) del C\u00f3digo Penal para el Estado de Jalisco, donde para los responsables de delitos por hechos de corrupci\u00f3n, se preve\u00eda la inhabilitaci\u00f3n perpetua para trabajar en el servicio p\u00fablico, as\u00ed como para participar en adquisiciones, arrendamientos, concesiones, servicios u obras p\u00fablicas, cuando el monto de la afectaci\u00f3n o beneficio obtenido por la comisi\u00f3n del delito, excediera el l\u00edmite de 200 veces el valor diario de la Unidad de Medida y Actualizaci\u00f3n.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Ello al considerar el Pleno que la sanci\u00f3n de inhabilitaci\u00f3n perpetua establecida en dicho precepto, se traduc\u00eda en una pena excesiva y desproporcional, que afectaba en grado predominante a la libertad de trabajo, el derecho de acceso a los cargos p\u00fablicos y el derecho a ser votado, generando un efecto <\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\">estigmatizante<\/span><\/span><span class=\"s6\"><span class=\"bumpedFont15\"> en la persona y que, por tanto, resultaba contraria a los art\u00edculos 18 y 22 de la Constituci\u00f3n Federal.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Por las mismas razones, invalid\u00f3 la fracci\u00f3n V del mismo art\u00edculo, donde se preve\u00eda la inhabilitaci\u00f3n perpetua como sanci\u00f3n para particulares, en el mismo supuesto de delitos por hechos de corrupci\u00f3n.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Adem\u00e1s, la SCJN invalid\u00f3 el art\u00edculo 117 de la Ley de Compras Gubernamentales, Enajenaciones y Contrataci\u00f3n de Servicios del Estado de Jalisco y sus Municipios, donde se preve\u00eda como sanci\u00f3n administrativa para los particulares que hubieren incurrido en actos de corrupci\u00f3n, la inhabilitaci\u00f3n perpetua para participar en adquisiciones, arrendamientos, servicios u obras p\u00fablicas.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s6\"><span class=\"bumpedFont15\">Ello al considerar el Pleno que, el establecimiento de sanciones administrativas a cargo de las entidades federativas debe encontrarse apegado a las bases y regulaciones previstas en la Ley General de Responsabilidades Administrativas, conforme lo precisa el art\u00edculo 73, fracci\u00f3n XXIX-V, de la Constituci\u00f3n Federal.<\/span><\/span><\/p>\n<p class=\"s9\"><span class=\"s10\">Acciones de inconstitucionalidad 59\/2019 y su acumulada 60\/2019, promovidas por la Fiscal\u00eda General de la Rep\u00fablica y la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez de diversas disposiciones del C\u00f3digo Penal para el Estado de Jalisco y de la Ley de Compras Gubernamentales, Enajenaciones y Contrataciones de Servicios del mencionado Estado y sus Municipios, publicados en el Peri\u00f3dico Oficial de esa entidad de 11 de mayo de 2019, mediante Decreto 27256\/LXII\/19.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LA INHABILITACI\u00d3N PERPETUA ES UNA PENA EXCESIVA Y DESPROPORCIONAL QUE VIOLA LA CONSTITUCI\u00d3N GENERAL
