DISCAPACIDAD"},"content":{"rendered":"<p><strong><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">INVALIDA SCJN REFORMAS A LA CONSTITUCI\u00d3N Y DIVERSAS LEYES DEL ESTADO DE CHIHUAHUA, POR FALTA DE CONSULTA PREVIA A PUEBLOS Y COMUNIDADES IND\u00cdGENAS Y PERSONAS CON DISCAPACIDAD<\/span><\/strong><\/p>\n<p>Por Redacci\u00f3n QP<\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">La Suprema Corte de Justicia de la Naci\u00f3n (SCJN), en sesi\u00f3n remota del Tribunal Pleno, efectuada a trav\u00e9s del sistema de videoconferencia, invalid\u00f3 los decretos publicados el 4 de marzo del a\u00f1o en curso, por medio de los cuales se reformaron la Constituci\u00f3n Pol\u00edtica, as\u00ed como las Leyes Org\u00e1nica del Poder Ejecutivo, Org\u00e1nica del Poder Judicial, de Derechos de los Pueblos Ind\u00edgenas y Electoral, todas del Estado de Chihuahua, al no haberse llevado a cabo una consulta a los pueblos y comunidades ind\u00edgenas y personas con discapacidad de la entidad.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">El Pleno determin\u00f3 que el contenido de todos los decretos impugnados incid\u00eda directamente en los intereses de los pueblos y comunidades ind\u00edgenas del Estado, por lo que, conforme a los art\u00edculos 2\u00b0 de la Constituci\u00f3n General y 6 del Convenio 169 de la OIT, las autoridades locales se encontraban obligadas a realizar una consulta de forma previa, libre, informada, culturalmente adecuada y de buena fe en la que participaran dichos grupos.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">Adicionalmente, se\u00f1al\u00f3 que, en particular, el decreto por el que se reform\u00f3 la Ley Org\u00e1nica del Poder Judicial Estatal regulaba tambi\u00e9n cuestiones relacionadas con las personas con discapacidad, a las que debi\u00f3 haberse consultado, en t\u00e9rminos del art\u00edculo 4, numeral 3, de la Convenci\u00f3n sobre los Derechos de las Personas con Discapacidad.<\/span><\/p>\n<p><span data-originalfontsize=\"12pt\" data-originalcomputedfontsize=\"16\">De este modo, invalid\u00f3 los Decretos LXVI\/RFCNT\/0512\/2019 I P.O., LXVI\/RFLEY\/0513\/2019 I P.O., LXVI\/RFLEY\/0665\/2020 III P.E. y LXVI\/RFLEY\/0666\/2020 III P.E. y, por extensi\u00f3n, el Decreto N\u00b0 LXVI\/DRFCT\/0688\/2020 I D.P., ordenando a la Legislatura Local efectuar la consulta y reformas correspondientes en un plazo m\u00e1ximo de doce meses, a partir de la notificaci\u00f3n de los puntos resolutivos de la sentencia.<\/span><\/p>\n<p><em><span data-removefontsize=\"true\" data-originalcomputedfontsize=\"16\">Acci\u00f3n de inconstitucionalidad 201\/2020, promovida por la Comisi\u00f3n Nacional de los Derechos Humanos, demandando la invalidez de los Decretos LXVI\/RFCNT\/0512\/2019 I P.O., LXVI\/RFLEY\/0513\/2019 I P.O., LXVI\/RFLEY\/0665\/2020 III P.E. y LXVI\/RFLEY\/0666\/2020 III P.E., mediante los cuales se reformaron la Constituci\u00f3n Pol\u00edtica y las Leyes Org\u00e1nica del Poder Ejecutivo, Org\u00e1nica del Poder Judicial, de Derechos de los Pueblos Ind\u00edgenas y Electoral, todas del Estado de Chihuahua, publicados en el Peri\u00f3dico Oficial de esa entidad federativa el 4 de marzo de
