QP<\/p>\n\n\n\n<p>La Suprema Corte de Justicia de la Naci\u00f3n&nbsp;otorg\u00f3 a la Alcald\u00eda Cuauht\u00e9moc&nbsp;facultades plenas&nbsp;para&nbsp;que \u00e9stacontin\u00fae con&nbsp;el cuidado, mantenimiento y preservaci\u00f3ndel monumento del \u00c1ngel de la Independencia&nbsp;as\u00ed como todas aquellas&nbsp;actividades que se requieran con lo que resolvi\u00f3 como ilegal la&nbsp;entrega, en su momento, al Gobierno Central.<\/p>\n\n\n\n<p>Esta resoluci\u00f3n de la SCJN se da luego de que\u00a0admiti\u00f3 a tr\u00e1mite la controversia constitucional\u00a0456\/2023,\u00a0presentada por la Alcaldesa,\u00a0Sandra Cuevas,\u00a0en la que se impugna la ilegal entrega del \u00c1ngel de la Independencia por parte de la Secretar\u00eda de Hacienda y Cr\u00e9dito P\u00fablico al Gobierno de la Ciudad de M\u00e9xico.<\/p>\n\n\n\n<p>La Corte tuvo como autoridades demandas al Poder Ejecutivo Federal\u00a0as\u00ed como al Poder Ejecutivo de la Ciudad de M\u00e9xico.<\/p>\n\n\n\n<p>La entrega realizada por las autoridades federales(SHCP) al Gobierno de la Ciudad de M\u00e9xico&nbsp;se hizo sin cumplir con las formalidades que exige la Ley General de Bienes Nacionales&nbsp;y sin considerar que la posesi\u00f3n corresponde a la Alcald\u00eda Cuauht\u00e9moc, quien ha acreditado que por lo menos desde 1998 tiene bajo su resguardo el monumento art\u00edstico m\u00e1s emblem\u00e1tico del pa\u00eds.<\/p>\n\n\n\n<p>Es importante se\u00f1alar que tanto la Constituci\u00f3n Pol\u00edtica de la Ciudad de M\u00e9xico como la Ley Org\u00e1nica de las Alcald\u00edas&nbsp;de la Ciudad de M\u00e9xico, les&nbsp;otorgan facultades coordinadas a las personas titulares de las alcald\u00edas para participar en el mantenimiento de los monumentos que sean de propiedad federal,&nbsp;que se encuentren dentro de su demarcaci\u00f3n territorial.<\/p>\n\n\n\n<p>Con acciones como \u00e9sta se hace valer el estado de Derecho y se hace
